재해위험 개선사업 및 이주대책에 관한 특별법 시행령 제17조(주민 등의 의견청취)

① 행정안전부장관 또는 시ㆍ도지사는 법 제14조에 따라 주민 등의 의견을 들으려는 때에는 관계 서류의 사본을 관할 시장ㆍ군수에게 송부하여야 한다. 다만, 제6조, 제10조 및 제13조에 따라 경미한 사항을 변경하려는 경우와 미리 관할 시장ㆍ군수가 법 제14조에 따라 주민 등의 의견을 청취한 경우에는 그러하지 아니하다. <개정 2009.8.18, 2014.11.19, 2017.7.26>

② 제1항에 따라 시장ㆍ군수가 관계 서류를 받으면 다음 각 호의 사항을 지방자치단체의 공보 등에 공고하여 14일 동안 주민이 그 서류를 열람할 수 있도록 하여야 한다.

③ 사업시행자는 제2항에 따른 공고기간이 만료한 후 1개월 내에 주민설명회를 개최하되, 다음 각 호의 사항을 시청ㆍ군청 또는 구청의 게시판 등 주민 등이 쉽게 접근할 수 있는 장소에 10일 이상 공고한 후 개최하여야 한다.

④ 행정안전부장관 또는 시ㆍ도지사가 필요하다고 인정하는 경우 주민 등의 의견을 듣기 위하여 공청회를 개최할 수 있다. <개정 2014.11.19, 2017.7.26>

⑤ 제4항에 따라 공청회를 개최하는 경우에는 관련 시ㆍ도를 주된 보급지역으로 하는 일간신문, 관보, 공보 또는 인터넷 홈페이지 등을 통하여 다음 각 호의 사항을 공청회 개최 예정일 14일 전까지 1회 이상 공고해야 한다. <개정 2020.11.24>

⑥ 주민, 토지 등 소유자 및 그 밖의 이해관계인 등은 공고기간 중 또는 주민설명회ㆍ공청회에 참석하여 서면이나 구두로 의견을 제출할 수 있다.

⑦ 시장ㆍ군수는 공고기간 중 제출된 의견이 있는 경우에는 이를 종합하여 행정안전부장관 또는 시ㆍ도지사에게 제출하여야 한다. <개정 2014.11.19, 2017.7.26>
