장애인복지법 시행령 제32조(장애수당등의 지급 시기 및 방법)

① 제30조에 따른 장애수당ㆍ장애아동수당 및 보호수당(이하 "장애수당등"이라 한다)은 그 신청일이 속한 달부터 지급하되, 장애수당등을 지급하지 아니하기로 결정한 달(해당 월분의 수당은 전부를 지급한다. 다만, 「국민기초생활 보장법」상의 부양의무자가 없는 장애수당등의 수급자가 사망한 경우 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장의 급여 결정 전에 이미 사망사실을 확인한 경우에는 지급하지 아니한다)까지 지급한다. <개정 2012.7.24, 2015.12.15>

② 장애수당등은 매월 20일(토요일이거나 공휴일인 경우에는 그 전날로 한다)에 금융기관이나 우편관서의 지급대상자 계좌에 입금하는 방법으로 지급한다. 이 경우 지급대상자로 결정된 사람이 다음 각 호의 어느 하나에 해당하는 경우에는 지급대상자의 배우자, 직계혈족 또는 3촌 이내의 방계혈족 명의 계좌에 입금할 수 있다. <개정 2009.12.31, 2010.3.15, 2015.12.15>

③ 제2항 후단에 따른 계좌에 장애수당등을 지급하려는 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 보건복지부장관이 정하는 바에 따라 미리 그 사유, 입금한 장애수당등의 사용목적 및 다른 용도 사용금지 등에 관한 사항을 안내하여야 한다. <신설 2009.12.31, 2010.3.15, 2015.12.15>

④ 제3항의 안내를 받고 제2항 후단에 따른 계좌로 장애수당등을 받으려는 자는 보건복지부령으로 정하는 서류를 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장에게 제출하여야 한다. <신설 2009.12.31, 2010.3.15, 2015.12.15>

⑤ 제2항에도 불구하고 지급대상자 또는 같은 항 후단에 따른 계좌로 입금받을 자가 금융기관 또는 우편관서가 없는 지역에 거주하는 등 부득이 한 사유가 있는 경우에는 해당 금전을 지급대상자 또는 같은 항 후단에 따른 계좌로 입금받을 자에게 직접 지급할 수 있다. <신설 2009.12.31>
