장애인복지법 시행규칙 제44조(시설운영의 중단ㆍ재개ㆍ폐지 신고 등)

① 장애인복지시설을 설치ㆍ운영하는 자는 법 제60조제2항에 따라 시설 운영을 일시중단또는 재개하거나 시설을 폐지하려는 경우에는 별지 제25호서식의 신고서에 다음 각 호의 서류를 첨부하여 시설 운영을 중단ㆍ재개 또는 폐지하기 3개월 전까지 관할 시장ㆍ군수ㆍ구청장에게 제출하여야 한다. <개정 2012.4.10>

② 시장ㆍ군수ㆍ구청장은 제1항에 따른 시설 운영의 중단ㆍ재개 또는 폐지의 신고를 받은 경우에는 제1항제2호ㆍ제3호ㆍ제6호 및 제7호의 조치계획 등에 따라 시설 이용자에 대한 조치가 적절히 이루어지는지를 확인하는 등 시설 이용자의 권익을 보호하기 위한 조치를 하여야 하며, 해당 장애인복지시설을 설치ㆍ운영하는 자는 법 제60조제3항 각 호 및 같은 조 제4항 각 호의 사항을 성실히 이행하여 시설 이용자의 권익이 침해받지 아니하도록 하여야 한다. <개정 2012.4.10>

③ 시장ㆍ군수ㆍ구청장은 제1항에 따른 시설 운영의 재개 신고를 받은 경우에 「소방시설 설치ㆍ유지 및 안전관리에 관한 법률 시행령」 별표 5에 따라 장애인복지시설이 갖추어야 하는 소방시설에 대하여 「소방시설 설치ㆍ유지 및 안전관리에 관한 법률」 제7조제6항 전단에 따라 그 장애인복지시설의 소재지를 관할하는 소방본부장이나 소방서장에게 그 장애인복지시설이 같은 법 또는 같은 법에 따른 명령을 따르고 있는지를 확인하여 줄 것을 요청하여야 한다. <신설 2015.8.3>
