장애인복지법 시행규칙 제38조(장애수당 등의 지급신청)

① 법 제50조의2제1항에 따라 장애수당ㆍ장애아동수당 및 보호수당(이하 "장애수당등"이라 한다)을 지급받으려는 사람은 장애수당등 지급신청서에 소득ㆍ재산신고서 및 금융정보등의 제공 동의서를 첨부하여 읍ㆍ면ㆍ동장을 거쳐 시장ㆍ군수ㆍ구청장에게 제출해야 한다. <개정 2009.12.31, 2012.4.10, 2012.7.27, 2022.9.6>

(1) A어 person퍼슨 who후 intends인텐즈 to투 receive^r러시^v브 a어 disability디서빌리티 allowance,얼라원스 child차일드 disability디서빌리티 allowance,얼라원스 or오 care케어 allowance얼라원스 (hereinafter히^r리내^f프터 referred^r러^f퍼드 to투 as애즈 "disability디서빌리티 allowances,얼라원시즈 etc.")엣세터^r러 pursuant퍼수언트 to투 Article아터클 50-2 (1) of어^v브 the^ð디 Act액트 shall섈 submit서브밋 an앤 application애플러케이션 for^f포 payment페이먼트 of어^v브 disability디서빌리티 allowances,얼라원시즈 etc.엣세터^r러 to투 the^ð더 head헤드 of어^v브 a어 Si/Gun/Gu시 via^v바이아 the^ð더 head헤드 of어^v브 an앤 Eup/Myeon/Dong,유프 attaching어태칭 a어 report^r리포트 on안 income인컴 and앤드 property프^r라퍼티 and앤드 a어 consent컨센트 to투 the^ð더 provision프^r러^v비전 of어^v브 financial^f퍼낸실 information,인^f퍼메이션 etc.엣세터^r러

② 제1항에 따라 장애수당등 지급신청서를 제출받은 읍ㆍ면ㆍ동장이 장애수당등의 지급을 신청한 사람의 주소지 관할이 아닌 경우에는 그 신청서와 관련 서류를 관할 읍ㆍ면ㆍ동장에게 지체 없이 이송해야 한다. <신설 2022.9.6>

③ 관할 시장ㆍ군수ㆍ구청장은 제1항에 따른 장애수당등의 지급신청을 받으면 영 제30조에 따른 지급대상인지를 조사ㆍ확인한 후 그 결과를 신청인에게 통지해야 한다. <개정 2012.4.10, 2012.7.27, 2022.9.6>

(3) Upon어판 receipt^r리싯 of어^v브 an앤 application애플러케이션 for^f포 payment페이먼트 of어^v브 disability디서빌리티 allowances,얼라원시즈 etc.엣세터^r러 under언더 paragraph패^r러그^r래^f프 (1), the^ð더 competent캄퍼틴트 head헤드 of어^v브 a어 Si/Gun/Gu시 shall섈 investigate인^v베스터게잇 and앤드 verify^v베^r러^f파이 whether웨^ð더 the^ð디 applicant애플리컨트 is이즈 eligible엘러저블 for^f포 payment페이먼트 under언더 Article아터클 30 of어^v브 the^ð더 Decree디크^r리 and앤드 then^ð덴 notify노우터^f파이 the^ð디 applicant애플리컨트 of어^v브 the^ð더 results.^r리절츠

④ 제3항에 따라 조사를 하는 공무원은 그 권한을 표시하는 증표를 지니고 관계인에게 내보여야 한다. <신설 2012.7.27, 2022.9.6>

⑤ 영 제32조제2항 후단에 따라 지급대상자의 배우자 등의 계좌로 장애수당등을 받으려는 사람은 별지 제17호서식의 장애수당등 대리수령 신청서(전자문서로 된 신청서를 포함한다)에 다음 각 호의 서류(전자문서를 포함한다)를 첨부하여 관할 시장ㆍ군수ㆍ구청장에게 제출해야 한다. <신설 2009.12.31, 2012.4.10, 2012.7.27, 2021.6.4, 2022.9.6>
