장사 등에 관한 법률 시행령 제40조의2(민감정보 및 고유식별정보의 처리)
Enforcement Decree of the Act on Funeral Services, etc., Article 40-2 (Processing of Sensitive Information and Personally Identifiable Information)
보건복지부장관, 그 밖의 중앙행정기관의 장 또는 지방자치단체의 장(해당 권한이 위임ㆍ위탁된 경우는 해당 권한을 위임ㆍ위탁받은 자를 포함한다)은 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법 시행령」 제18조제1호에 따른 유전정보(제3호의 사무로 한정한다), 같은 조 제2호에 따른 범죄경력자료에 해당하는 정보(제15호의 사무로 한정한다)와 같은 영 제19조제1호 또는 제4호에 따른 주민등록번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다. <개정 2015.7.20, 2020.1.7, 2022.12.20>
The Minister of Health and Welfare, the head of another central administrative agency, or the head of a local government (including a person to whom the relevant authority has been delegated or entrusted) may, where unavoidable to perform the following affairs, process genetic information under Article 18 subparagraph 1 of the Enforcement Decree of the Personal Information Protection Act (limited to the affairs in subparagraph 3), information constituting criminal history data under subparagraph 2 of the same Article (limited to the affairs in subparagraph 15), and data containing resident registration numbers or foreigner registration numbers under Article 19 subparagraph 1 or 4 of the same Decree:
1. 법 제8조에 따른 매장ㆍ화장 및 개장의 신고에 관한 사무
1. Affairs concerning reports of burial, cremation, and reburial under Article 8 of the Act;
2. 법 제11조에 따른 묘지의 일제 조사에 관한 사무
2. Affairs concerning the comprehensive survey of graves under Article 11 of the Act;
3. 법 제12조에 따른 무연고 시신 등의 처리에 관한 사무
3. Affairs concerning the disposal of unclaimed corpses, etc. under Article 12 of the Act;
3의2. 법 제12조의2에 따른 유류금품의 처분에 관한 사무
3-2. Affairs concerning the disposition of abandoned money and valuables under Article 12-2 of the Act;
4. 법 제14조에 따른 사설묘지의 설치 등에 관한 사무
4. Affairs concerning the installation of private cemeteries, etc. under Article 14 of the Act;
5. 법 제15조에 따른 사설화장시설 등의 설치에 관한 사무
5. Affairs concerning the installation of private crematoria, etc. under Article 15 of the Act;
6. 법 제16조에 따른 자연장지의 조성 등에 관한 사무
6. Affairs concerning the development of natural burial grounds, etc. under Article 16 of the Act;
7. 법 제19조에 따른 분묘의 설치기간 연장 등에 관한 사무

8. 법 제20조에 따른 설치기간이 종료된 분묘의 처리에 관한 사무
8. Affairs concerning the disposal of graves whose installation period has ended under Article 20 of the Act;
9. 법 제22조에 따른 묘적부의 기록ㆍ관리에 관한 사무
9. Affairs concerning the recording and management of grave registers under Article 22 of the Act;
10. 법 제23조, 제23조의2 및 제24조에 따른 공설묘지 등의 사용료 또는 관리비에 관한 사무
10. Affairs concerning usage fees or management fees of public cemeteries, etc. under Articles 23, 23-2, and 24 of the Act;
11. 법 제26조에 따른 장사시설의 폐지 등에 관한 사무
11. Affairs concerning the closure of funeral facilities, etc. under Article 26 of the Act;
12. 법 제27조에 따른 타인의 토지 등에 설치된 분묘 등의 처리 등에 관한 사무
12. Affairs concerning the disposal of graves, etc. installed on another person's land, etc. under Article 27 of the Act;
13. 법 제28조에 따른 무연분묘의 처리에 관한 사무
13. Affairs concerning the disposal of unattended graves under Article 28 of the Act;
14. 법 제29조에 따른 장례식장영업에 관한 사무
