자유무역지역의 지정 및 운영에 관한 법률 제25조(토지 또는 공장등의 처분제한)

① 입주기업체등은 제14조제2항에 따른 공장설립등의 완료신고 전 또는 같은 조 제4항 전단에 따른 사업개시의 신고 전에 제17조제1항, 제18조제1항 또는 이 조 제2항에 따라 취득한 토지(이 조 제6항에 따라 분할된 토지를 포함한다) 또는 공장등을 처분하려는 경우에는 이를 관리권자에게 양도하여야 한다.

② 관리권자가 제1항에 따른 토지 또는 공장등을 양수하기 곤란하다고 인정하는 경우에는 대통령령으로 정하는 바에 따라 입주기업체등으로 하여금 관리권자가 선정한 다른 입주기업체등이나 입주 자격이 있는 제3자에게 이를 양도하게 할 수 있다.

③ 입주기업체등이 제14조제2항에 따른 공장설립등의 완료신고 후 또는 같은 조 제4항 전단에 따른 사업개시의 신고 후에 제17조제1항 또는 제18조제1항에 따라 취득한 토지 또는 공장등을 양도 또는 임대[전대(轉貸)를 포함한다. 이하 같다]하거나 이를 타인으로 하여금 사용하게 하는 경우 그 계약 당사자는 입주기업체등이나 입주 자격이 있는 제3자로 한정한다.

④ 제3항의 경우에 국가 또는 지방자치단체가 소유하는 토지 위에 건축한 공장등을 양도 또는 임대하거나 이를 타인으로 하여금 사용하게 할 때에는 관리권자에게 그 사실을 신고하여야 한다.

⑤ 제1항 및 제2항에 따른 토지의 양도가격은 그가 취득한 가격에 대통령령으로 정하는 이자 및 비용을 합산한 금액으로 하고, 공장등의 양도가격은 「감정평가 및 감정평가사에 관한 법률」에 따른 감정평가법인등의 시가감정액을 고려하여 결정할 수 있다. 다만, 입주기업체등이 요청한 경우 토지의 양도가격은 그가 취득한 가격에 대통령령으로 정하는 이자 및 비용을 합산한 금액 이하로 할 수 있다. <개정 2016.1.19, 2020.4.7>

⑥ 입주기업체등이 소유하고 있는 토지를 분할하려는 경우에는 미리 관리권자와 협의하여 산업통상부령으로 정하는 면적 이상으로 분할하여야 한다. <개정 2013.3.23, 2025.10.1>

⑦ 세관장은 입주기업체가 외국물품등을 사용하여 건축한 공장등을 공장등의 완료신고 또는 사업개시일부터 3년 이내에 지원업체에 임대ㆍ양도한 경우에는 입주기업체로부터 면제되었거나 환급된 관세등을 즉시 징수하여야 한다. 다만, 대통령령으로 정하는 바에 따라 세관장의 허가를 받아 공장등의 일부를 지원업체에 임대한 경우는 제외한다. <신설 2016.1.27>
