자연유산의 보존 및 활용에 관한 법률 제23조(천연기념물 또는 명승의 공개)

① 천연기념물 또는 명승은 공개하여야 한다.

② 제1항에도 불구하고 국가유산청장이 천연기념물 또는 명승의 보존과 훼손 방지를 위하여 필요하다고 인정하는 경우에는 해당 천연기념물 또는 명승의 전부나 일부에 대하여 공개를 제한할 수 있다. 이 경우 국가유산청장은 해당 천연기념물 또는 명승의 소유자등의 의견을 들어야 한다. <개정 2024.2.13>

③ 국가유산청장은 제2항에 따라 천연기념물 또는 명승의 공개를 제한하는 경우 해당 자연유산이 소재하는 지역의 위치, 공개가 제한되는 기간 및 범위 등을 문화체육관광부령으로 정하는 바에 따라 고시하고, 해당 천연기념물 또는 명승의 소유자등, 관할 시ㆍ도지사와 시장ㆍ군수 또는 구청장에게 알려야 한다. <개정 2024.2.13>

④ 국가유산청장은 제2항에 따른 공개 제한의 사유가 소멸하면 지체 없이 제한 조치를 해제하여야 한다. 이 경우 국가유산청장은 문화체육관광부령으로 정하는 바에 따라 이를 고시하고 해당 천연기념물 또는 명승의 소유자등, 관할 시ㆍ도지사와 시장ㆍ군수 또는 구청장에게 알려야 한다. <개정 2024.2.13>

⑤ 제2항에 따라 공개가 제한되는 천연기념물 또는 명승에 학술연구ㆍ관리실태 조사나 해당 천연기념물 또는 명승의 보존ㆍ활용을 위하여 출입하려는 자는 문화체육관광부령으로 정하는 바에 따라 그 사유를 명시하여 국가유산청장의 허가를 받아야 한다. <개정 2024.2.13, 2025.4.8>

⑥ 국가유산청장은 제5항에 따른 허가의 신청을 받은 날부터 30일 이내에 허가 여부를 신청인에게 통지하여야 한다. <개정 2024.2.13>

⑦ 국가유산청장이 제6항에서 정한 기간 내에 허가 또는 변경허가 여부나 민원 처리 관련 법령에 따른 처리기간의 연장을 신청인에게 통지하지 아니하면 그 기간(민원 처리 관련 법령에 따라 처리기간이 연장 또는 재연장된 경우에는 해당 처리기간을 말한다)이 끝난 날의 다음 날에 허가 또는 변경허가를 한 것으로 본다. <개정 2024.2.13>
