자동차관리법 제72조(보고ㆍ검사)

① 국토교통부장관, 기후에너지환경부장관(종합검사 및 이륜자동차검사와 관련된 업무에만 해당한다), 시ㆍ도지사, 시장ㆍ군수ㆍ구청장은 자동차의 관리업무를 위하여 필요하다고 인정하면 다음 각 호의 자에게 그 관리 또는 업무에 관한 보고를 하게 할 수 있다. <개정 2011.5.24, 2013.3.23, 2017.10.24, 2018.6.12, 2022.11.15, 2023.8.16, 2023.9.14, 2024.1.30, 2025.10.1, 2026.2.27>

② 국토교통부장관, 기후에너지환경부장관(종합검사 및 이륜자동차검사와 관련된 업무에만 해당한다), 시ㆍ도지사, 시장ㆍ군수ㆍ구청장은 필요하다고 인정하면 소속 공무원으로 하여금 제1항 각 호의 자의 시설ㆍ장비ㆍ자동차ㆍ사업장 또는 사무소에 출입하여 관련 자동차ㆍ장부ㆍ서류 또는 그 밖의 물건을 검사하거나 관계인에게 질문하게 할 수 있다. 이 경우 기후에너지환경부장관은 종합검사 또는 이륜자동차검사를 시행하는 자에 대한 출입ㆍ검사가 합동으로 실시되도록 하여야 한다. <개정 2013.3.23, 2023.9.14, 2025.10.1>

③ 제2항에 따라 검사할 때에는 검사 7일 전까지 검사 일시, 검사 목적 및 검사 내용 등을 기재한 검사 계획을 검사대상자에게 알려야 한다. 다만, 긴급히 검사해야 하거나 사전에 검사 계획이 알려지면 검사 목적을 달성할 수 없다고 인정되는 경우에는 사전에 알리지 아니할 수 있으며, 검사 후 즉시 사후결과보고서를 작성하여야 한다.

④ 제2항에 따라 출입ㆍ검사를 하는 공무원은 그 권한을 표시하는 증표를 지니고 이를 관계인에게 내보여야 한다.
