Enforcement Decree of the Motor Vehicle Management Act, Article 8-3 (Requirements for Presuming Defects in Motor Vehicles and Motor Vehicle Parts)

① 법 제30조제2항에 따른 자동차제작자등(이하 "자동차제작자등"이라 한다) 또는 자동차부품을 제작ㆍ조립 또는 수입하는 자(이하 "부품제작자등"이라 한다)가 제작ㆍ조립 또는 수입하는 자동차 또는 부품이 다음 각 호의 어느 하나에 해당함에도 법 제31조제5항에 따라 자료를 제출하지 않은 경우에는 같은 조 제6항에 따라 자동차 또는 부품에 결함이 있는 것으로 추정한다. <개정 2024.7.30>

② 국토교통부장관은 법 제30조의3제2항, 제31조제4항 및 같은 조 제9항에 따른 조사를 성능시험대행자에게 실시하게 하는 경우로서 그 조사를 위하여 같은 조 제13항 전단에 따른 자료를 성능시험대행자에게 제공할 필요가 있다고 인정하면 기후에너지환경부장관에게 해당 자료의 제공을 요청할 수 있다. <개정 2025.10.1>
