임기제부사관제 운영규정 제2조(선발)

① 「병역법」(이하 "법"이라 한다) 제20조의2제2항제1호에 따라 병역준비역에 편입된 사람 중에서 같은 조 제1항에 따른 임기제부사관(이하 "임기제부사관"이라 한다)을 선발하는 경우 그 선발절차 등에 관하여는 「병역법 시행령」 제29조제1항부터 제5항까지의 규정을 준용한다. 이 경우 "현역병복무지원자"는 "임기제부사관지원자"로, "현역병 지원서"는 "임기제부사관 지원서"로 본다.

② 법 제20조의2제2항제2호에 따라 현역병으로 복무 중인 사람 중에서 임기제부사관을 선발하는 경우에는 법 제18조에 따른 복무기간(법 제19조에 따라 복무기간이 조정되는 경우에는 그 조정된 기간을 말한다. 이하 같다)이 만료되기 전에 선발한다.

③ 제2항에 따라 임기제부사관을 선발하는 경우 그 선발기준, 모집공고 및 선발절차 등에 관하여 필요한 사항은 각 군 참모총장(해병대의 경우에는 해병대사령관을 말한다. 이하 같다)이 정한다.
