의무소방대설치법 시행령 제4조(의무소방원임용예정자의 선발 및 선발시험의 실시)

①소방청장은 법 제3조제2항의 규정에 의하여 의무소방원임용예정자를 국방부장관에게 추천하고자 하는 때에는 18세 이상의 병역준비역 또는 보충역에 해당하는 사람중에서 지원을 받은 후 의무소방원임용예정자공개경쟁선발시험(이하 "의무소방원선발시험"이라 한다)을 실시하여 그 대상자를 선발하여야 한다. <개정 2004.5.24, 2014.11.19, 2016.11.29, 2017.7.26>

②제1항의 규정에 의한 의무소방원선발시험은 신체검사와 면접시험으로 한다. 다만, 소방청장이 필요하다고 인정하는 때에는 그 외에 선택형 필기시험을 추가할 수 있다. <개정 2004.5.24, 2014.11.19, 2017.7.26>

③제2항 단서의 규정에 불구하고 전산ㆍ운전ㆍ위험물ㆍ소방설비ㆍ소방점검보조 또는 구급업무보조 등 특수업무의 수행을 위한 자격증의 소지자를 선발하고자 하는 때에는 선택형 필기시험에 갈음하여 실기시험을 실시할 수 있다.

④제2항 및 제3항의 규정에 의한 의무소방원선발시험은 다음 각호의 구분에 의한 단계에 따라 순차적으로 실시하되, 앞 단계의 시험에 합격하지 아니한 자는 다음 단계의 시험에 응시할 수 없다. <개정 2004.5.24, 2014.11.19, 2017.7.26>

⑤제4항의 규정에 의하여 의무소방원선발시험을 단계별로 실시함에 있어서 소방청장이 필요하다고 인정하는 때에는 앞단계 시험의 합격 결정전에 다음 단계의 시험을 실시할 수 있다. <신설 2003.5.29, 2004.5.24, 2014.11.19, 2017.7.26>
