의무소방대설치법 시행령 제33조(감사원에서의 조사와의 관계 등)

①감사원에서 조사중인 사건에 대하여는 제3항의 규정에 의한 조사개시의 통보를 받은 날부터 징계의결의 요구 그 밖의 징계절차를 진행하지 못한다.

②공소청(광역공소청, 지방공소청 및 지방공소청 지청을 포함한다. 이하 같다) 또는 중대범죄수사청ㆍ경찰 그 밖의 수사기관에서 수사 중(공소청의 경우에는 해당 사건이 송치된 후 공소제기 여부를 결정하기 전인 경우를 말한다)인 사건에 대하여는 제3항의 규정에 의한 수사개시의 통보를 받은 날부터 징계의결의 요구 그 밖의 징계절차를 진행하지 아니할 수 있다. <개정 2026.9.29>

③감사원과 중대범죄수사청ㆍ경찰 그 밖의 수사기관은 의무소방원과 관련된 조사나 수사를 개시한 때와 이를 종료한 때, 공소청은 공소제기 여부를 결정한 때에는 10일 이내에 의무소방원 소속기관의 장에게 당해 사실을 통보하여야 한다. <개정 2026.9.29>
