의료 해외진출 및 외국인환자 유치 지원에 관한 법률 제4조(의료 해외진출의 신고)

① 의료 해외진출을 하려는 「의료법」 제3조에 따른 의료기관의 개설자는 보건복지부장관에게 신고하여야 한다.

② 제1항에 따라 신고하려는 자가 법인인 경우 「의료법」 또는 관계 법령에 따라 그 정관에 의료 해외진출에 관한 사항을 포함하여야 한다.

③ 보건복지부장관은 제1항에 따른 신고를 받은 날부터 10일 이내에 신고수리 여부를 신고인에게 통지하여야 한다. <신설 2018.9.18>

(3) The^ð더 Minister미너스터 of어^v브 Health헬^θ스 and앤드 Welfare웰^f페어 shall섈 notify노우터^f파이 the^ð더 reporter^r리포터 of어^v브 whether웨^ð더 the^ð더 report^r리포트 is이즈 accepted액셉티드 within위^ð딘 10 days데이즈 from^f프^r럼 the^ð더 date데잇 of어^v브 receiving^r러시^v빙 the^ð더 report^r리포트 under언더 paragraph패^r러그^r래^f프 (1).

④ 보건복지부장관이 제3항에서 정한 기간 내에 신고수리 여부 또는 민원 처리 관련 법령에 따른 처리기간의 연장을 신고인에게 통지하지 아니하면 그 기간(민원 처리 관련 법령에 따라 처리기간이 연장 또는 재연장된 경우에는 해당 처리기간을 말한다)이 끝난 날의 다음 날에 신고를 수리한 것으로 본다. <신설 2018.9.18>

(4) If이^f프 the^ð더 Minister미너스터 of어^v브 Health헬^θ스 and앤드 Welfare웰^f페어 does더즈 not낫 notify노우터^f파이 the^ð더 reporter,^r리포터 within위^ð딘 the^ð더 period피^r리어드 prescribed프^r리스크^r라이브드 in인 paragraph패^r러그^r래^f프 (3), of어^v브 whether웨^ð더 the^ð더 report^r리포트 is이즈 accepted액셉티드 or오 of어^v브 an앤 extension익스텐션 of어^v브 the^ð더 processing프^r라세싱 period피^r리어드 under언더 statutes스태춧츠 relating^r릴레이팅 to투 civil시^v블 petition퍼티션 processing,프^r라세싱 the^ð더 report^r리포트 is이즈 deemed딤드 accepted액셉티드 on안 the^ð더 day데이 following^f팔로잉 the^ð디 end엔드 of어^v브 that^ð댓 period피^r리어드 (where웨어 the^ð더 processing프^r라세싱 period피^r리어드 is이즈 extended익스텐디드 or오 re-extended^r레이-익스텐디드 under언더 statutes스태춧츠 relating^r릴레이팅 to투 civil시^v블 petition퍼티션 processing,프^r라세싱 that^ð댓 processing프^r라세싱 period).피^r리어드

⑤ 보건복지부장관은 제1항에 따른 신고를 수리한 경우(제4항에 따라 신고를 수리한 것으로 보는 경우를 포함한다)에는 의료기관의 개설자에게 의료 해외진출의 신고확인증을 발급하여야 한다. <개정 2018.9.18>

(5) Where웨어 the^ð더 Minister미너스터 of어^v브 Health헬^θ스 and앤드 Welfare웰^f페어 has해즈 accepted액셉티드 a어 report^r리포트 under언더 paragraph패^r러그^r래^f프 (1) (including인클루딩 cases케이시즈 where웨어 a어 report^r리포트 is이즈 deemed딤드 accepted액셉티드 under언더 paragraph패^r러그^r래^f프 (4)), the^ð더 Minister미너스터 shall섈 issue이슈 a어 report^r리포트 confirmation칸^f퍼메이션 certificate서티^f피컷 of어^v브 overseas오우^v버시즈 expansion익스팬션 of어^v브 medicine메더슨 to투 the^ð디 operator아퍼^r레이터 of어^v브 the^ð더 medical메더클 institution.인스티투션

⑥ 제1항에 따른 신고의 내용, 절차, 시기 및 제5항에 따른 확인증 발급 등에 필요한 사항은 대통령령으로 정한다. <개정 2018.9.18>
