의료급여법 시행규칙 제8조의2(임신ㆍ출산 진료비의 지원)

① 시장ㆍ군수ㆍ구청장은 임신 중이거나 출산(유산 또는 사산을 포함한다. 이하 같다)한 수급권자가 보건복지부장관이 정하여 고시하는 기준에 해당하는 의료급여기관에서 받는 진료(해당 수급권자의 2세 미만인 자녀에 대한 진료를 포함한다)에 드는 비용과 약제ㆍ치료재료(해당 수급권자의 2세 미만인 자녀에 대하여 처방된 약제ㆍ치료재료를 포함한다)의 구입에 드는 비용(이하 이 조에서 "임신ㆍ출산 진료비"라 한다)을 지원하되, 그 지급액은 다음 각 호의 구분에 따른 금액의 범위에서 임신 중이거나 출산한 수급권자 본인이 부담하는 금액으로 한다. 다만, 보건복지부장관이 필요하다고 인정하여 고시하는 경우에는 다음 각 호의 상한을 초과하여 지원할 수 있다. <개정 2010.2.26, 2010.3.19, 2010.9.7, 2011.3.30, 2012.3.30, 2012.6.29, 2016.6.29, 2016.12.30, 2017.9.15, 2018.12.31, 2020.6.29, 2021.9.14>

② 임신ㆍ출산 진료비는 제8조제1항에 따른 의료급여대상 외에 제9조에 따른 비급여대상에도 사용할 수 있다. <개정 2010.2.26>
