Enforcement Rule of the Medical Aid Act, Article 28 (Management and Operation of the Fund)

①시장ㆍ군수ㆍ구청장은 의료급여사업에 충당하기 위하여 기금의 교부를 신청하고자 하는 때에는 별지 제20호서식에 의하여 시ㆍ도지사에게 신청하여야 한다. <개정 2012.11.21>

②제1항의 규정에 의한 신청을 받은 시ㆍ도지사는 시장ㆍ군수ㆍ구청장에게 기금을 교부한 경우 다음 각호의 1에 해당하는 때에는 교부한 기금의 전부 또는 일부를 반환할 것을 명하거나 필요한 조치를 하여야 한다.

③시장ㆍ군수ㆍ구청장은 시ㆍ도지사로부터 교부받은 기금에 대하여는 일반회계와 구분하여 별도의 계정(이하 "기금계정"이라 한다)을 설정ㆍ운용하여야 한다.

④시장ㆍ군수ㆍ구청장은 대지급금의 상환, 부당이득금의 징수 등으로 교부받은 기금이 소요비용을 초과하여 잉여금이 발생한 경우에는 그 전액을 지체없이 시ㆍ도지사에게 반환하여야 한다. <개정 2013.12.13>

⑤시장ㆍ군수ㆍ구청장은 회계연도마다 기금계정의 결산에 관한 서류를 작성하여 다음해 2월 말일까지 시ㆍ도지사에게 제출하여야 하며, 결산상 잉여금이 발생한 경우에는 그 전액을 시ㆍ도지사에게 반환하여야 한다.

⑥시ㆍ도지사는 법 제33조제2항의 규정에 의한 업무위탁시에 소요되는 비용으로 의료급여비용심사위탁수수료, 수급권자전산관리위탁수수료, 급여비용지급위탁수수료 및 의료급여의 적정성평가 위탁수수료 등 소요비용을 의료급여기금계정에 계상하여야 한다.
