① 국가책임기관의 장은 다음 각 호의 어느 하나에 해당하는 경우에는 관계 중앙행정기관의 장과 협의하여 국내 유전자원등에 대한 접근 및 이용을 금지하거나 제한할 수 있다.

1. 「생물다양성 보전 및 이용에 관한 법률」 제2조제1호의 생물다양성(이하 이 항에서 "생물다양성"이라 한다)의 보전 및 지속적인 이용에 위해(危害)를 끼치거나 끼칠 우려가 있다고 인정하는 경우
