유료도로관리권등록령 제56조(합병)

①갑 유료도로관리권을 분할하여 그 일부를 을 유료도로관리권에 합병한 경우에 합병의 등록을 하는 때에는 을 유료도로관리권의 등록용지중 표시란에 합병으로 인하여 등록 몇호의 유료도로관리권의 등록용지로부터 이기한 취지를 기재하고, 종전의 표시와 그 번호를 붉은 선으로 지워야 한다. <개정 2021.1.5>

②제1항의 경우에는 을 유료도로관리권의 등록용지 중 갑구 사항란에 갑 유료도로관리권의 등록용지로부터 유료도로관리권에 관한 등록을 전사하고, 그 등록이 합병한 부분만에 관한것이라는 취지, 신청서 접수의 연월일과 접수번호를 기재하고, 등록공무원이 날인하여야 한다.

③갑 유료도로관리권의 등록용지에 저당권에 관한 등록이 있을 때에는 을 유료도로관리권의 등록용지중 해당구사항란에 그 권리에 관한 등록을 전사하고 합병한 부분만이 갑 유료도로관리권과 같이 그 권리의 목적이 되는 취지, 신청서 접수의 연월일과 접수번호를 기재하고 등록공무원이 날인하여야 한다.

④저당권에 관한 등록을 전사하는 경우에 등록원인 그 연월일, 등록의 목적과 접수번호가 동일할 때에는 전사에 갈음하여 을 유료도로관리권의 등록용지에 갑 유료도로관리권의 번호와 그 유료도로관리권에 대하여 동일사항의 등록이 있다는 취지를 기재하여야 한다.

⑤제54조제2항ㆍ제4항 및 제5항과 제55조의 규정은 제1항의 경우에 이를 준용한다.
