유료도로관리권등록령 제54조(분할)

①갑 유료도로관리권을 분할하여 그 일부를 을 유료도로관리권으로 한 경우에 그 분할의 등록을 하는 때에는 등록용지중 등록번호란에 번호를 기재하고, 표시란에 분할로 인하여 등록 몇호의 유료도로관리권 등록용지로부터 이기한 취지를 기재하여야 한다.

②제1항에 따른 이기를 한 경우에는 갑 유료도로관리권의 등록용지중 표시란에 잔여부분의 표시를 하고 분할로 인하여 다른 부분을 등록 몇호의 유료도로관리권의 등록용지에 이기한 취지를 기재한 후 종전의 표시와 그 번호를 붉은 선으로 지워야 한다. <개정 2021.1.5>

③제1항의 경우에는 을 유료도로관리권의 등록용지중 해당구 사항란에 갑 유료도로관리권의 등록용지로부터 유료도로관리권 또는 저당권에 관한 등록을 전사하고 저당권에 관한 등록증에 갑 유료도로관리권과 같이 그 권리의 목적이 되는 취지, 신청서 접수의 연월일과 접수번호를 기재한 후 등록공무원이 날인하여야 한다.

④갑 유료도로관리권의 등록용지로부터 을 유료도로관리권의 등록용지에 저당권에 대한 등록을 전사한 때에는 갑 유료도로관리권의 등록용지중 그 권리에 관한 등록에 을 유료도로관리권과 같이 그 권리의 목적이 되는 취지를 부기하여야 한다.

⑤신청서에 저당권의 등록명의인이 을 유료도로관리권에 관하여 그 권리의 소멸을 승낙한 것을 증명하는 서면 또는 이에 대항할수 있는 재판의 등본을 첨부한 때에는 갑 유료도로관리권의 등록용지중 당해 권리에 관한 등록에 그 취지를 부기하여야 한다.
