Enforcement Decree of the Act on Promotion of Production and Use of Biogas from Organic Waste Resources, Article 10 (Delegation and Entrustment of Authority and Work)
① 기후에너지환경부장관은 법 제19조제1항에 따라 다음 각 호의 권한을 지방환경관서의 장에게 위임한다. <개정 2025.10.1>
(1) Pursuant to Article 19 (1) of the Act, the Minister of Climate, Energy and Environment delegates the following authority to the heads of regional environmental offices:
1. 법 제8조에 따라 바이오가스 의무생산자에게 부과하는 과징금에 관한 다음 각 목의 권한
1. The following authority concerning penalty surcharges imposed on biogas mandatory producers under Article 8 of the Act:
가. 법 제8조제1항에 따른 과징금의 부과ㆍ징수 및 같은 조 제2항에 따른 감면
(a) Imposition and collection of penalty surcharges under Article 8 (1) of the Act and reduction or exemption thereof under paragraph (2) of that Article;
나. 법 제8조제5항에 따른 체납된 과징금의 납부 독촉 및 가산금 부과
(b) Demand for payment of delinquent penalty surcharges and imposition of additional dues under Article 8 (5) of the Act;
다. 법 제8조제6항에 따른 과징금 및 가산금의 강제징수
(c) Compulsory collection of penalty surcharges and additional dues under Article 8 (6) of the Act;
라. 법 제8조제9항에 따른 관련 자료의 제출 요청
(d) Requests for submission of related materials under Article 8 (9) of the Act;
2. 법 제18조제1항에 따른 보고, 자료 제출 요구 및 검사
2. Reports, requests for submission of materials, and inspections under Article 18 (1) of the Act;
3. 법 제21조제1항제1호, 제4호 및 제5호에 따른 과태료의 부과ㆍ징수
3. Imposition and collection of administrative fines under Article 21 (1) 1, 4, and 5 of the Act.
② 기후에너지환경부장관은 법 제19조제2항에 따라 법 제14조에 따른 비용 지원에 관한 업무(민간의무생산자에 대한 비용 지원 업무로 한정한다)를 한국환경공단에 위탁한다. <개정 2025.10.1>
(2) Pursuant to Article 19 (2) of the Act, the Minister of Climate, Energy and Environment entrusts the work concerning cost support under Article 14 (limited to cost support for private mandatory producers) to the Korea Environment Corporation.
