Act on the Establishment and Operation of the Nuclear Safety and Security Commission, Article 14 (Exclusion, Challenge, and Recusal of Members)

① 위원이 다음 각 호의 어느 하나에 해당하는 경우에는 그 직무집행에서 제척된다.

(1) A어 member멤버 shall섈 be비 excluded익스클루디드 from^f프^r럼 performing퍼^f포밍 duties두티즈 in인 any에니 of어^v브 the^ð더 following^f팔로잉 cases:케이시즈

1. 위원 또는 그 배우자나 배우자이었던 사람이 해당 사안의 당사자가 되거나 해당 사안에 관하여 공동권리자 또는 의무자의 관계에 있는 경우

2. 위원이 해당 사안의 당사자와 친족관계에 있거나 있었던 경우

3. 위원이 해당 사안에 관하여 증언이나 감정을 한 경우

4. 위원이 해당 사안에 관하여 당사자의 대리인으로서 관여하거나 관여하였던 경우

② 위원회는 직권 또는 당사자의 신청에 의하여 제척의 결정을 한다.

(2) The^ð더 Commission커미션 shall섈 decide디사이드 on안 exclusion익스클루전 ex엑스 officio어^f피시오 or오 upon어판 application애플러케이션 by바이 a어 party.파티

③ 위원에게 심의ㆍ의결의 공정을 기대하기 어려운 사정이 있는 경우 당사자는 기피신청을 할 수 있고, 위원회는 의결로 이를 결정한다.

④ 위원이 제1항 또는 제3항의 사유가 있는 경우에는 해당 사안에 대하여 회피할 수 있다.
