원자력안전법 시행령 제146조의2(적극적인 정보공개의 대상정보 및 방법)
Enforcement Decree of the Nuclear Safety Act, Article 146-2 (Information Subject to Proactive Disclosure and Methods)
① 법 제103조의2제1항 본문에서 "원자력이용시설에 대한 건설허가 및 운영허가 관련 심사결과와 원자력안전관리에 관한 검사결과 등 대통령령으로 정하는 정보"란 다음 각 호의 정보를 말한다. <개정 2025.12.23>
(1) The term "information prescribed by Presidential Decree, such as review results related to construction permits and operating permits for nuclear utilization facilities and inspection results on nuclear safety management" in the main clause of Article 103-2 (1) of the Act means the following information:
1. 법 제10조제2항에 따라 발전용원자로 및 관계시설의 건설허가 신청 시 제출하는 서류
1. Documents submitted when applying for a construction permit for a power reactor and related facilities under Article 10 (2) of the Act;
2. 법 제20조제2항에 따라 발전용원자로 및 관계시설의 운영허가 신청 시 제출하는 서류
2. Documents submitted when applying for an operating permit for a power reactor and related facilities under Article 20 (2) of the Act;
3. 법 제23조제1항 단서에 따라 계속운전을 하려는 경우 제출하는 주기적 안전성 평가보고서 및 이 영 제37조제2항 각 호의 평가에 관한 사항
3. The periodic safety assessment report and matters concerning the assessments in each subparagraph of Article 37 (2) of this Decree, submitted when intending continued operation under the proviso of Article 23 (1) of the Act;
4. 제20조 및 제33조제3항에 따른 원자로시설의 건설허가 및 운영허가 관련 심사보고서
4. Review reports related to construction permits and operating permits for reactor facilities under Articles 20 and 33 (3);
5. 제27조에 따른 원자로시설의 공사 및 성능에 관한 사용 전 검사결과
5. Pre-use inspection results concerning construction and performance of reactor facilities under Article 27;
6. 제31조의2에 따라 공급자 및 성능검사기관에 대하여 실시한 검사결과
6. Inspection results conducted on suppliers and performance verification bodies under Article 31-2;
7. 제35조제1항에 따른 원자로시설의 성능에 관한 정기검사결과
7. Periodic inspection results concerning the performance of reactor facilities under Article 35 (1); and
8. 그 밖에 원자력안전에 관한 사항으로서 위원회가 적극적인 공개가 필요한 것으로 정하여 고시하는 정보
8. Other information on nuclear safety that the Commission determines and publicly notifies as requiring proactive disclosure.
② 위원회는 법 제103조의2제1항에 따라 이 조 제1항에 따른 정보를 공개할 때 해당 정보에 「공공기관의 정보공개에 관한 법률」 제9조제1항 각 호의 어느 하나에 해당하는 정보가 포함되어 있는 경우에는 같은 법 제14조에 따라 해당 부분은 제외하고 공개하여야 한다.
(2) When disclosing information under paragraph (1) pursuant to Article 103-2 (1) of the Act, where the information includes information falling under any subparagraph of Article 9 (1) of the Act on Disclosure of Information by Public Institutions, the Commission shall disclose it excluding that portion under Article 14 of the same Act.
③ 위원회는 제1항 각 호의 정보를 위원회의 홈페이지에 게시하는 방법으로 공개하여야 한다.
(3) The Commission shall disclose the information in each subparagraph of paragraph (1) by posting it on the Commission's website.
④ 제1항부터 제3항까지의 규정에 따른 정보공개의 방법 및 시기 등에 관하여는 위원회가 정하여 고시한다.
(4) The methods and timing, etc. of information disclosure under paragraphs (1) through (3) shall be determined and publicly notified by the Commission.
