Enforcement Decree of the Nuclear Safety Act, Article 105-3 (Application for Approval of Decommissioning of Radioactive Waste Storage Facilities, etc.)

① 방사성폐기물저장시설등의 건설ㆍ운영 허가를 받은 자(이하 "방사성폐기물저장시설등건설ㆍ운영자"라 한다)는 법 제68조의3제1항 전단에 따라 방사성폐기물저장시설등의 해체 승인을 받으려는 경우 법 제64조제2항에 따라 영구정지에 관한 변경허가를 받고 그 방사성폐기물저장시설등을 영구정지한 날부터 2년 이내에 총리령으로 정하는 바에 따라 해체 승인신청서를 작성하여 위원회에 제출해야 한다.

② 위원회는 제1항에 따른 신청을 받은 경우 18개월 이내에 다음 각 호의 기준에 따라 승인 여부를 결정해야 한다.

③ 다음 각 호의 기간은 제2항에 따른 승인 처리기간에 산입하지 않는다.
