연근해어업의 구조개선 및 지원에 관한 법률 제4조(어업실태조사)

① 해양수산부장관과 광역시장ㆍ도지사ㆍ특별자치도지사(이하 "시ㆍ도지사"라 한다)는 어업구조개선사업을 효율적으로 추진하기 위하여 매년 다음 각 호의 사항에 대한 실태조사(이하 "어업실태조사"라 한다)를 하여야 한다. 이 경우 근해어업에 대하여는 해양수산부장관이, 연안어업ㆍ구획어업 및 정치망어업에 대하여는 시ㆍ도지사가 시장ㆍ군수ㆍ구청장(구청장은 자치구의 구청장을 말하며, 이하 "시장ㆍ군수ㆍ구청장"이라 한다)의 의견을 들어 어업실태조사를 하여야 한다. <개정 2013.3.23, 2022.1.11>

② 해양수산부장관과 시ㆍ도지사는 어업실태조사를 위하여 필요한 경우 소속 공무원으로 하여금 어업자의 어선, 어장, 사업장 및 사무소 등에 출입하여 조사하게 할 수 있다. <개정 2013.3.23>

③ 제2항에 따라 다른 사람의 어선, 어장 등을 출입하는 공무원은 그 권한을 표시하는 증표를 지니고 이를 관계인에게 보여주어야 한다.
