연근해어업의 구조개선 및 지원에 관한 법률 제10조(감척 대상 어업의 직권지정)

① 해양수산부장관이나 시ㆍ도지사는 어업자단체등이 제8조에 따른 지정 신청 기간에 감척 대상 어업의 지정을 신청하지 아니하더라도 다음 각 호의 어느 하나에 해당하는 경우에는 직권으로 감척 대상 어업(「수산업법」 제7조에 따른 정치망어업은 제외한다)을 지정할 수 있다. <개정 2013.3.23, 2022.1.11, 2024.1.23>

② 해양수산부장관이나 시ㆍ도지사가 직권으로 감척 대상 어업을 지정하려면 어선ㆍ어구 감척 계획서를 작성하여 근해어업의 경우에는 시ㆍ도지사와, 연안어업 및 구획어업의 경우에는 시장ㆍ군수ㆍ구청장과 협의하고, 해당 어업자단체등의 의견을 들은 후 해당 수산조정위원회의 심의를 거쳐야 한다. <개정 2013.3.23, 2018.3.13>
