연구개발특구의 육성에 관한 특별법 제41조(건축물등의 양도명령)

① 과학기술정보통신부장관은 제37조(제38조제2항 및 제39조에 따라 입주계약을 체결하여야 하는 경우를 포함한다)에 따른 입주계약을 체결하지 아니한 자 또는 제40조제1항에 따라 입주계약이 해지된 입주기관에 대하여는 6개월 이상의 기간을 정하여 그 기관이 소유하는 교육ㆍ연구 및 사업화 시설구역의 건축물등을 양도할 것을 명할 수 있다. 입주기관이 해당 사업을 폐업한 경우에도 또한 같다. <개정 2013.3.23, 2017.7.26, 2020.12.22>

② 제1항에 따라 건축물등을 양도하는 경우에는 제38조제3항 및 제4항을 준용한다.
