여객자동차 운수사업법 시행규칙 제16조(사업면허)

① 관할관청은 제12조에 따라 여객자동차운송사업의 면허신청을 받은 경우 그 신청서류를 심사하여 면허요건에 적합하다고 인정하면 제14조제1항에 따른 시설등을 확인할 일시를 지정하여 그 신청인에게 알려야 한다.

② 관할관청은 제1항에 따라 지정된 일시에 시설등을 확인한 후 시설등이 제14조제1항에 따른 기준을 충족한 때에는 여객자동차운송사업의 면허를 하여야 한다. 이 경우 지역 실정과 운송질서의 확립 등을 위하여 필요하다고 인정하면 법 제4조제3항에 따라 조건을 붙여 면허할 수 있다.

③ 관할관청은 제2항에 따른 시설등의 확인을 해당 시설등의 소재지를 관할하는 시ㆍ도지사에게 의뢰할 수 있다.

④ 관할관청은 제1항에 따른 신청서류의 심사 결과 면허기준에 맞지 아니하다고 인정하는 경우나 제2항에 따른 확인 결과 시설등의 기준에 미치지 못하는 경우 또는 해당 신청인이 사실확인을 위한 조사활동 등에 협조하지 아니하는 경우에는 면허를 하여서는 아니 된다. 이 경우 관할관청은 그 이유를 분명히 밝혀서 신청인에게 알려야 한다.
