Enforcement Rule of the Fishing Villages and Fishing Ports Act, Article 10 (Procedures and Criteria for Designation of Fishing Ports)

①해양수산부장관, 광역시장ㆍ도지사ㆍ특별자치도지사(이하 "시ㆍ도지사"라 한다) 또는 시장ㆍ군수ㆍ구청장이 법 제17조제1항에 따라 어항을 지정하려는 경우에는 어항지정의 타당성 여부를 판단하기 위하여 어항개발의 필요성이 제기되는 어항(이하 "지정대상어항"이라 한다) 및 그 인근어항에 대하여 다음 각 호의 사항을 미리 조사하여야 한다. <개정 2008.3.3, 2008.10.29, 2013.3.24>

③ 해양수산부장관은 제2항에도 불구하고 이용범위가 전국적이거나 섬, 외딴 곳에 있어 어장의 개발 및 어선의 대피에 필요한 경우로써 지방어항, 어촌정주어항, 마을공동어항 또는 그 밖의 항ㆍ포구가 다음 각 호의 어느 하나에 해당하는 경우에는 해당 지방어항, 어촌정주어항, 마을공동어항 또는 그 밖의 항ㆍ포구를 국가어항으로 지정할 수 있다. <신설 2014.9.25>
