어장관리법 제8조(면허ㆍ허가동시갱신)

① 시장ㆍ군수ㆍ구청장은 어장을 효율적으로 관리하기 위하여 필요하다고 인정되는 때에는 관할 어장관리해역별로 면허ㆍ허가동시갱신을 실시할 수 있다. 다만, 시장ㆍ군수ㆍ구청장은 그 어장관리해역 중 「수산업법」 제13조제5항 및 「양식산업발전법」 제15조제1항부터 제3항까지에 따라 어업면허 또는 양식업면허의 우선순위에서 제외되는 자가 어업을 경영하는 어장은 시ㆍ군ㆍ구수산조정위원회의 심의를 거쳐 면허ㆍ허가동시갱신을 실시하지 아니할 수 있다. <개정 2009.4.22, 2013.8.13, 2019.8.27, 2022.1.11>

② 시장ㆍ군수ㆍ구청장은 면허ㆍ허가동시갱신을 실시하려면 미리 그 시기 등에 관하여 해당 어장관리해역 안에서 어업면허, 어업허가 또는 양식업면허를 받은 자의 의견을 듣고, 시ㆍ군ㆍ구수산조정위원회의 심의를 거쳐야 한다. <개정 2013.8.13, 2019.8.27>

③ 시장ㆍ군수ㆍ구청장은 면허ㆍ허가동시갱신을 실시한 어장이 「수산업법」 제34조(같은 법 제50조에 따라 준용되는 경우를 포함한다)에 따라 어업면허 또는 어업허가가 취소된 경우 또는 「양식산업발전법」 제27조에 따라 양식업면허가 취소된 경우 그 해역 안의 다른 인근 어장의 어업면허 또는 양식업면허 유효기간(유효기간의 연장 허가기간을 포함한다. 이하 같다) 또는 어업허가 유효기간이 지날 때까지 그 수면에 대하여 새로운 어업면허, 어업허가 또는 양식업면허를 하여서는 아니 된다. <개정 2009.4.22, 2013.8.13, 2019.8.27, 2022.1.11>

④ 시장ㆍ군수ㆍ구청장은 제1항 단서에 따라 면허ㆍ허가동시갱신을 실시하지 아니한 어장이 「수산업법」 제34조에 따라 어업면허가 취소되거나 어업면허 유효기간이 지난 경우 또는 「양식산업발전법」 제27조에 따라 양식업면허가 취소되거나 양식업면허 유효기간이 지난 경우 그 해역 안의 인근 어장의 어업면허 또는 양식업면허 유효기간이 지날 때까지 그 수면에 대하여 새로운 어업면허 또는 양식업면허를 하여서는 아니 된다. <개정 2009.4.22, 2013.8.13, 2019.8.27, 2022.1.11>

⑤ 시장ㆍ군수ㆍ구청장은 면허ㆍ허가동시갱신을 실시한 어장관리해역 안에 새로운 어업면허, 어업허가 또는 양식업면허를 하거나 어업면허 또는 양식업면허 유효기간을 연장하여 허가할 때에는 그 해역 안의 인근 어장의 어업면허, 어업허가 또는 양식업면허의 유효기간과 일치하도록 어업면허ㆍ어업허가ㆍ양식업면허 또는 어업면허ㆍ양식업면허 유효기간의 연장허가를 하여야 한다. <개정 2019.8.27>
