어선법 제5조의2(어선위치발신장치)

① 어선의 안전운항을 확보하기 위하여 제2조제1호가목 또는 나목에 해당하는 어선(「내수면어업법」에 따른 내수면어업에 종사하는 어선 등 해양수산부령으로 정하는 어선은 제외한다)의 소유자는 해양수산부장관이 정하는 기준에 따라 어선의 위치를 자동으로 발신하는 장치(이하 "어선위치발신장치"라 한다)를 갖추고 이를 작동하여야 한다. 다만, 해양경찰청장은 해양사고 발생 시 신속한 대응과 어선 출항ㆍ입항 신고 자동화 등을 위하여 필요한 경우 그 기준을 정할 수 있다. <개정 2013.3.23, 2014.11.19, 2017.7.26, 2018.12.31>

② 제5조제1항에 따른 무선설비가 어선위치발신장치의 기능을 가지고 있는 때에는 어선위치발신장치를 갖춘 것으로 본다.

③ 제1항에 따른 어선의 소유자 또는 선장은 어선위치발신장치가 고장나거나 이를 분실한 경우 지체 없이 그 사실을 해양경찰청장에게 신고한 후 대통령령으로 정하는 기한까지 어선위치발신장치를 정상 작동하기 위한 수리 또는 재설치 등의 조치를 하여야 한다. <개정 2014.11.19, 2017.7.26, 2017.10.31, 2020.2.18>

④ 국가 또는 지방자치단체는 어선위치발신장치를 설치하는 어선의 소유자에 대하여 예산의 범위에서 그 설치비용의 전부 또는 일부를 지원할 수 있다.
