Enforcement Rule of the Fishing Vessel Act, Article 59-5 (Application for Designation of Type Approval Testing Institutions)
① 법 제24조의3제1항에 따른 형식승인시험기관(이하 "형식승인시험기관"이라 한다)으로 지정받으려는 자는 별지 제53호의2서식의 형식승인시험기관 지정신청서(전자문서로 된 신청서를 포함한다)에 다음 각 호의 서류(전자문서를 포함한다)를 첨부하여 해양수산부장관에게 제출하여야 한다. <개정 2025.12.19>
(1) A person who intends to be designated as a type approval testing institution under Article 24-3 (1) of the Act (hereinafter referred to as a "type approval testing institution") shall submit an application for designation as a type approval testing institution in Form No. 53-2 (including an application in electronic form) to the Minister of Oceans and Fisheries, accompanied by the following documents (including electronic documents):
1. 기관의 연혁, 설립 목적, 주요 기능 및 조직에 관한 사항을 적은 서류
1. Documents stating the history, purpose of establishment, main functions, and organization of the institution;
2. 법 제24조제1항 후단 및 제2항 후단에 따른 형식승인시험(이하 "형식승인시험"이라 한다)에 종사할 인원 및 그 자격을 적은 서류와 그 증빙서류(해당 시험업무에 종사가 가능함을 증명하는 서류를 말한다)
2. Documents stating the number and qualifications of personnel to be engaged in type approval testing under the latter part of Article 24 (1) and the latter part of paragraph (2) of the same Article of the Act (hereinafter referred to as "type approval testing") and supporting documents (referring to documents proving that they can engage in the relevant testing work);
3. 형식승인시험에 필요한 시설과 장비(「국가표준기본법」 또는 「계량에 관한 법률」에 따라 교정ㆍ검정을 받은 기기를 포함한다. 이하 이 조에서 같다)의 목록, 사양서 및 교정ㆍ검정을 받은 기기의 관리계획서
3. A list and specifications of facilities and equipment necessary for type approval testing (including instruments calibrated or verified under the Framework Act on National Standards or the Measures Act; the same shall apply hereinafter in this Article) and a management plan for calibrated or verified instruments;
4. 시험ㆍ검사기관 인정서(영 제4조의2제1항제4호의 경우로 한정한다)
4. A certificate of accreditation as a testing and inspection institution (limited to cases under Article 4-2 (1) 4 of the Decree);
5. 다음 각 목의 사항이 포함된 시설ㆍ장비이용계획서
5. A plan for use of facilities and equipment including the following matters:
가. 영 제4조의2제2항제1호의 경우
(a) In the case of Article 4-2 (2) 1 of the Decree:
1) 시설 또는 장비의 임차 사유
1) Reasons for leasing facilities or equipment;
2) 임차하려는 시설 또는 장비의 종류
2) Types of facilities or equipment to be leased;
3) 임차하려는 시설의 소재지 또는 장비의 제조자의 명칭 및 주요 기능에 관한 사항
3) Matters concerning the location of the facilities to be leased or the name of the manufacturer and main functions of the equipment;
나. 영 제4조의2제2항제2호의 경우
(b) In the case of Article 4-2 (2) 2 of the Decree:
1) 다른 시험기관에의 의뢰 사유
1) Reasons for requesting another testing institution;
2) 의뢰하려는 시험항목
2) Test items to be requested;
3) 의뢰하려는 다른 시험기관의 명칭, 소재지 및 주요 업무에 관한 사항
3) Matters concerning the name, location, and main business of the other testing institution to be requested;
6. 제59조의6제2항에 따른 지정기준 인정서(해당하는 경우에 한정한다)
6. A certificate of recognition of designation standards under Article 59-6 (2) (limited to cases where applicable).
② 해양수산부장관은 제1항에 따른 신청을 받은 경우 영 제4조의2에 따른 지정기준에 적합하다고 인정되는 경우에는 별지 제53호의3서식의 형식승인시험기관 지정서를 신청인에게 발급하여야 한다. 이 경우 해당 시험기관의 시험능력 등을 고려하여 일부 시험항목에 한정하여 지정할 수 있다.
(2) Upon receipt of an application under paragraph (1), where the applicant is recognized as meeting the designation standards under Article 4-2 of the Decree, the Minister of Oceans and Fisheries shall issue a certificate of designation as a type approval testing institution in Form No. 53-3 to the applicant. In such cases, the designation may be limited to some test items, taking into consideration the testing capability, etc. of the relevant testing institution.
③ 해양수산부장관은 제2항에 따라 형식승인시험기관을 지정한 경우에는 이를 고시하여야 한다.
(3) Where the Minister of Oceans and Fisheries has designated a type approval testing institution under paragraph (2), the Minister shall publicly notify it.
④ 형식승인시험기관은 영 제4조의2에 따른 지정기준에 관한 사항 또는 제2항 후단에 따른 시험항목을 변경하려는 경우에는 그 변경 내용 및 사유에 관한 서류를 해양수산부장관에게 제출하여야 한다.
(4) Where a type approval testing institution intends to change matters concerning the designation standards under Article 4-2 of the Decree or the test items under the latter part of paragraph (2), it shall submit documents on the details of and reasons for the change to the Minister of Oceans and Fisheries.
⑤ 해양수산부장관은 제4항에 따른 서류를 제출받은 경우 영 제4조의2에 따른 지정기준에의 적합 여부를 확인하여야 한다.
(5) Upon receipt of documents under paragraph (4), the Minister of Oceans and Fisheries shall confirm whether the designation standards under Article 4-2 of the Decree are met.
