양식산업발전법 제36조(양식업권의 경매)

① 제21조제2항, 제27조제1항제2호부터 제5호까지 또는 제6호(제26조제1항제8호 또는 제9호의 경우에만 해당한다)에 따라 면허가 취소된 경우 그 양식업권의 저당권자로 양식업권원부에 등록된 자는 제27조제2항에 따른 통지를 받은 다음 날부터 30일 이내에 양식업권의 경매를 신청할 수 있다.

② 제1항에 따라 경매를 신청한 경우에는 해당 양식업권은 면허를 취소한 날부터 경매절차가 끝난 날까지 경매목적의 범위에서 존속하는 것으로 본다.

③ 양식업권을 경매로 낙찰받은 경락인이 경매대금을 완납한 때에는 면허의 취소는 효력이 발생하지 아니한 것으로 본다.
