양식산업발전법 제22조(휴업 및 양식업권 포기 신고)

① 양식업권자는 계속해서 1년 이상 양식업을 휴업하려는 경우에는 미리 휴업기간을 정하여 면허권자에게 신고하여야 한다. 다만, 다음 각 호의 어느 하나에 해당하는 경우에는 휴업을 할 수 없다.

② 제1항 각 호 외의 부분 단서에도 불구하고 양식업권자는 천재지변이나 그 밖에 부득이한 사유로 수산종자를 확보할 수 없는 경우에는 미리 면허권자에게 신고를 하고 1년 이내의 범위에서 휴업기간을 연장받을 수 있다.

③ 제1항 또는 제2항에 따라 신고를 한 자가 신고한 휴업기간이 끝나기 전에 양식업을 재개하려는 경우에는 미리 면허권자에게 신고하여야 한다.

④ 제1항 및 제2항에 따른 휴업기간에는 제26조 또는 제54조에 따른 처분이나 명령에 따라 양식업을 정지한 기간 및 「어장관리법」 제9조에 따른 어장휴식 기간은 포함하지 아니한다.

⑤ 양식업권자가 양식업권을 포기하려는 경우에는 해양수산부령으로 정하는 바에 따라 면허권자에게 신고하여야 한다.
