약사법 제45조(의약품 판매업의 허가)

①제44조 제2항 제2호에 따른 한약업사 및 의약품도매상이 되려는 자는 보건복지부령이 정하는 바에 따라 시장ㆍ군수ㆍ구청장의 허가를 받아야 한다. 허가 받은 사항을 변경할 경우에도 또한 같다. <개정 2008.2.29, 2010.1.18, 2011.6.7>

② 제1항에 따라 허가를 받으려는 한약업사 또는 의약품 도매상은 다음 각 호의 구분과 같이 시설을 갖추어야 한다. <개정 2011.3.30, 2014.3.18, 2015.1.28>

③제1항에 따른 한약업사는 보건복지부령이 정하는 지역에 한정하여 대통령령으로 정하는 한약업사시험에 합격한 자에게 허가한다. <개정 2008.2.29, 2010.1.18>

④제1항에 따라 허가를 받은 한약업사는 환자가 요구하면 기존 한약서에 실린 처방 또는 한의사의 처방전에 따라 한약을 혼합 판매할 수 있다.

⑤제1항에 따라 허가를 받은 의약품 도매상은 약사를 두고 업무를 관리하게 하여야 하며, 한약 도매상은 다음 각 호의 어느 하나에 해당하는 자를 두고 업무를 관리하게 하여야 한다. 다만, 의약품 도매상 자신이 약사로서 업무를 직접 관리하거나, 한약 도매상이 다음 각 호의 어느 하나에 해당한 자로서 업무를 직접 관리하는 경우에는 그러하지 아니하다. <개정 2008.2.29, 2010.1.18>

⑥ 의약품 도매상 및 한약 도매상은 제5항에 따라 업무를 관리하는 자를 두려는 경우에는 보건복지부령으로 정하는 바에 따라 시장ㆍ군수ㆍ구청장에게 신고하여야 한다. 이 경우 시장ㆍ군수ㆍ구청장은 그 내용을 검토하여 이 법에 적합하면 신고를 수리하여야 한다. <신설 2011.6.7, 2019.1.15>

⑦제1항에 따른 허가의 기준, 조건 및 관리에 필요한 사항은 보건복지부령으로 정한다. <개정 2008.2.29, 2010.1.18, 2011.6.7>

⑧ 제5항에도 불구하고 보건복지부령으로 정하는 요건을 갖춘 다른 의약품 도매상에 의약품의 보관ㆍ배송 등 유통관리 업무를 위탁하는 경우에는 제5항에 따른 업무관리자를 두지 아니할 수 있다. 다만, 이 경우 해당 유통관리 업무를 위탁받는 자는 보건복지부령으로 정하는 바에 따라 제5항에 따른 업무관리자를 두어야 한다. <신설 2015.12.29>
