액화석유가스의 안전관리 및 사업법 제48조(허가관청 등의 조치)

① 허가관청, 등록관청 또는 시장ㆍ군수ㆍ구청장은 대통령령으로 정하는 바에 따라 이 법에 따른 허가를 받았거나 등록을 한 자, 액화석유가스 특정사용자 또는 액화석유가스 사용자에게 위해 방지를 위하여 필요한 조치를 명할 수 있다.

② 허가관청, 등록관청 또는 시장ㆍ군수ㆍ구청장은 이 법에 따른 허가를 받았거나 등록을 한 자, 액화석유가스 특정사용자 또는 액화석유가스 사용자의 액화석유가스의 충전ㆍ집단공급ㆍ판매ㆍ영업소ㆍ위탁운송ㆍ저장ㆍ사용시설이나 용기ㆍ가스용품(이하 이 항에서 "시설등"이라 한다)으로 인하여 위해가 발생하였거나 위해의 발생이 긴박하여 긴급하고 부득이하다고 인정할 때에는 그 시설등의 이전ㆍ사용정지 또는 사용제한을 명하거나 그 시설등의 안에 있는 액화석유가스를 폐기하도록 명할 수 있으며, 그 시설등을 봉인할 수 있다.

③ 제2항에 따른 명령이나 조치가 사업자의 귀책사유 없이 공공의 안전유지를 위하여 이루어진 경우 허가관청, 등록관청 또는 시장ㆍ군수ㆍ구청장은 해당 사업자에게 발생한 손실에 대하여 대통령령으로 정하는 바에 따른 정당한 보상을 하여야 한다. 다만, 천재지변ㆍ전쟁, 그 밖의 불가항력의 사유로 인한 경우에는 그러하지 아니하다.
