액화석유가스의 안전관리 및 사업법 제34조(안전관리자)

① 액화석유가스 사업자등과 제44조제2항에 따른 액화석유가스 특정사용자는 그 시설ㆍ용기ㆍ가스용품 등의 안전 확보와 위해 방지에 관한 직무를 수행하게 하기 위하여 산업통상부령으로 정하는 바에 따라 사업을 시작하거나 액화석유가스를 사용하기 전에 안전관리자를 선임하여야 한다. 다만, 액화석유가스 특정사용자의 사용시설 중 저장설비를 이용하여 다수의 사용자가 액화석유가스를 사용하는 시설로서 산업통상부령으로 정하는 시설은 그 시설에 액화석유가스를 공급하는 사업자가 안전관리자를 선임하여야 한다. <개정 2025.10.1>

② 제1항에 따른 안전관리자를 선임 또는 해임하거나 안전관리자가 퇴직한 경우에는 지체 없이 그 사실을 허가관청 또는 등록관청이나 시장ㆍ군수ㆍ구청장에게 신고하고, 해임하거나 퇴직한 날부터 30일 이내에 다른 안전관리자를 선임하여야 한다. 다만, 30일 이내에 선임할 수 없을 경우에는 허가관청 또는 등록관청이나 시장ㆍ군수ㆍ구청장의 승인을 받아 그 기간을 연장할 수 있다.

③ 제1항에 따라 안전관리자를 선임한 자는 다음 각 호의 어느 하나에 해당하는 경우에는 대통령령으로 정하는 바에 따라 대리자를 지정하여 일시적으로 안전관리자의 직무를 대행하게 하여야 한다. <개정 2016.1.6>

④ 안전관리자는 그 직무를 성실히 수행하여야 하며, 그 액화석유가스 사업자등과 제44조제2항에 따른 액화석유가스 특정사용자 및 종사자는 안전관리자의 안전에 관한 의견을 존중하고 권고에 따라야 한다.

⑤ 허가관청 또는 등록관청이나 시장ㆍ군수ㆍ구청장은 대통령령으로 정하는 안전관리자가 그 직무를 성실히 수행하지 아니하면 그 안전관리자를 선임한 액화석유가스 사업자등이나 제44조제2항에 따른 액화석유가스 특정사용자에게 그 안전관리자의 해임을 요구할 수 있다.

⑥ 허가관청 또는 등록관청이나 시장ㆍ군수ㆍ구청장은 제5항에 따라 안전관리자의 해임을 요구한 경우 해당 안전관리자가 그 직무를 성실히 수행하지 아니한 사실을 산업통상부장관에게 알려야 한다. <개정 2025.10.1>

⑦ 제2항에 따른 신고가 신고서의 기재사항 및 첨부서류에 흠이 없고 법령 등에 규정된 형식상의 요건을 충족하는 경우에는 신고서가 접수기관에 도달된 때에 신고된 것으로 본다. <신설 2022.2.3>
