액화석유가스의 안전관리 및 사업법 제16조(처분효과의 승계)

제12조에 따라 액화석유가스 사업자등의 지위가 승계되면 종전의 액화석유가스 사업자등에 대한 제13조에 따른 사업의 정지 또는 제한처분(제14조에 따라 사업의 정지 또는 제한명령을 갈음하여 부과하는 과징금을 포함한다)의 효과는 그 지위를 승계받은 자에게 승계되며, 처분의 절차가 진행 중일 때에는 지위를 승계받은 자에 대하여 그 절차를 진행할 수 있다. 다만, 지위를 승계받은 자(상속에 의하여 승계를 받은 자는 제외한다)가 승계를 받은 때에 그 처분 또는 위반사실을 알지 못하였음을 증명하는 경우에는 그러하지 아니하다.
