액화석유가스의 안전관리 및 사업법 제13조(허가ㆍ등록의 취소 등)
Liquefied Petroleum Gas Safety Control and Business Act, Article 13 (Revocation of Permits and Registration)
① 허가관청이나 등록관청은 액화석유가스 사업자등이 다음 각 호의 어느 하나에 해당하면 그 허가나 등록을 취소하거나 6개월 이내의 기간을 정하여 그 사업 또는 액화석유가스 저장소 사용의 정지 또는 제한을 명할 수 있다. 다만, 제1호, 제2호, 제7호 또는 제9호의4에 해당하면 그 허가나 등록을 취소하여야 한다. <개정 2017.11.28, 2019.8.20>
(1) The permitting authority or registration authority may revoke the permit or registration of a liquefied petroleum gas business operator, etc. or order suspension or restriction of the business or the use of the liquefied petroleum gas storage facility for a period not exceeding six months if the operator falls under any of the following: Provided, That in the case of subparagraph 1, 2, 7, or 9-4, the permit or registration shall be revoked:
1. 거짓이나 그 밖의 부정한 방법으로 제5조나 제8조에 따른 허가를 받거나 제9조에 따른 등록을 한 경우
1. Where it obtained a permit under Article 5 or 8 or registered under Article 9 by fraud or other improper means;
2. 허가를 받은 날 또는 등록을 한 날부터 정당한 사유 없이 1년 이내에 그 사업 또는 액화석유가스 저장소의 사용을 시작하지 아니하거나 1년 이상 계속하여 그 사업 또는 액화석유가스 저장소의 사용을 하지 아니한 경우
2. Where, without justifiable grounds, it did not commence the business or the use of the liquefied petroleum gas storage facility within one year from the date of the permit or registration, or did not carry on the business or the use of the liquefied petroleum gas storage facility continuously for one year or more;
3. 고의나 과실로 공중(公衆) 또는 사용자에게 현저히 위해를 끼친 경우
3. Where it intentionally or negligently caused significant harm to the public or users;
4. 제5조, 제6조 또는 제8조에 따른 허가 기준이나 제9조에 따른 등록 기준에 미달하게 된 경우
4. Where it came to fall short of the permit standards under Article 5, 6, or 8 or the registration standards under Article 9;
5. 제5조제2항에 따라 판매지역을 위반하여 판매한 경우 또는 같은 조 제8항의 명령을 위반한 경우
5. Where it sold in violation of the sales area under Article 5 (2) or violated an order under Article 5 (8);
6. 제5조제3항 본문 또는 제8조제2항 본문을 위반하여 변경허가를 받지 아니하거나 제9조제2항 본문을 위반하여 변경등록을 하지 아니한 경우
6. Where it failed to obtain a change permit in violation of the main clause of Article 5 (3) or Article 8 (2), or failed to register a change in violation of the main clause of Article 9 (2);
7. 제7조의 결격사유에 해당하게 된 경우
7. Where it came to fall under the grounds for disqualification in Article 7;
8. 정당한 사유 없이 가스 공급을 거절하거나 다른 사업자에게 가스 공급을 거절하도록 요구하거나 권고한 경우
8. Where it refused to supply gas without justifiable grounds, or demanded or recommended that another business operator refuse to supply gas;
9. 제23조제1항부터 제3항까지의 규정 중 어느 하나를 위반한 경우
9. Where it violated any of Article 23 (1) through (3);
9의2. 제23조의2제1항을 위반한 경우
9-2. Where it violated Article 23-2 (1);
9의3. 제23조의2제2항을 위반한 경우
9-3. Where it violated Article 23-2 (2);
9의4. 제23조의2제1항과 제2항을 모두 위반하여 정량 미달 공급을 목적으로 영업시설을 설치ㆍ개조하거나 그 설치ㆍ개조한 영업시설을 양수ㆍ임차하고 이를 사용하여 액화석유가스를 정량에 미달되게 공급한 경우
9-4. Where it violated both Article 23-2 (1) and (2), installed or modified business facilities for the purpose of short-measure supply or acquired or leased the installed or modified business facilities, and used them to supply liquefied petroleum gas in less than the proper quantity;
10. 제25조제1항에 따른 공급규정을 위반한 경우
10. Where it violated the supply rules under Article 25 (1);
11. 제26조제3항을 위반하여 액화석유가스를 판매 또는 인도하거나 판매 또는 인도할 목적으로 저장ㆍ운송 또는 보관한 경우
11. Where it sold or delivered liquefied petroleum gas, or stored, transported, or kept it for the purpose of sale or delivery, in violation of Article 26 (3);
12. 제27조제2항에 따른 품질검사를 거부ㆍ방해ㆍ기피한 경우
12. Where it refused, obstructed, or evaded a quality inspection under Article 27 (2);
13. 제30조제1항 또는 제2항을 위반한 경우
13. Where it violated Article 30 (1) or (2);
14. 제32조제1항 또는 제2항을 위반한 경우
14. Where it violated Article 32 (1) or (2);
15. 제33조제1항에 따른 명령을 위반한 경우
15. Where it violated an order under Article 33 (1);
16. 제33조제3항을 위반하여 수요자의 요청을 이행하지 아니한 경우
16. Where it failed to comply with a consumer's request in violation of Article 33 (3);
17. 제34조제1항 또는 제2항을 위반한 경우
17. Where it violated Article 34 (1) or (2);
18. 제36조제1항 또는 제2항을 위반한 경우
18. Where it violated Article 36 (1) or (2);
19. 제37조제1항을 위반하여 정기검사 또는 수시검사를 받지 아니한 경우
19. Where it failed to undergo a periodic or ad hoc inspection in violation of Article 37 (1);
20. 제39조제1항을 위반하여 검사를 받지 아니한 경우
20. Where it failed to undergo an inspection in violation of Article 39 (1);
21. 제40조제2항을 위반하여 회수명령 또는 공표명령을 이행하지 아니한 경우
21. Where it failed to comply with an order of recall or publication in violation of Article 40 (2);
21의2. 제40조제4항을 위반하여 제조한 가스용품에 표시하여야 할 사항을 표시하지 아니한 경우
21-2. Where it failed to display the matters to be displayed on the gas appliances it manufactured, in violation of Article 40 (4);
22. 제53조에 따른 조정명령을 거부한 경우
22. Where it refused an order of adjustment under Article 53;
23. 제64조제2항에 따라 준용되는 「석유 및 석유대체연료 사업법」 제23조에 따른 판매가격의 최고액보다 높은 가격으로 액화석유가스를 판매한 경우
23. Where it sold liquefied petroleum gas at a price higher than the maximum sale price under Article 23 of the Petroleum and Alternative Fuel Business Act, which applies mutatis mutandis under Article 64 (2); and
24. 「고압가스 안전관리법」 제17조제5항을 위반하여 검사나 재검사를 받지 아니한 용기등을 양도ㆍ임대 또는 사용(가스를 충전하는 행위를 포함한다)하거나 판매할 목적으로 진열한 경우
24. Where it transferred, leased, or used (including filling with gas) containers, etc. that did not undergo inspection or re-inspection, in violation of Article 17 (5) of the High Pressure Gas Safety Control Act, or displayed them for sale.
② 허가관청이나 등록관청은 액화석유가스 사업자등이 다음 각 호의 어느 하나에 해당하면 그 법인이 제7조제6호에 해당하게 된 날 또는 지위를 승계한 상속인의 상속이 개시된 날부터 6개월 동안은 제1항을 적용하지 아니한다.
(2) The permitting authority or registration authority shall not apply paragraph (1) for six months from the date the corporation came to fall under Article 7 6, or from the date inheritance commenced for the heir who succeeded to the status, if a liquefied petroleum gas business operator, etc. falls under any of the following:
1. 액화석유가스 사업자등의 지위를 승계한 상속인이 제7조제1호부터 제5호까지의 규정 중 어느 하나에 해당하게 된 경우
1. Where the heir who succeeded to the status of the liquefied petroleum gas business operator, etc. came to fall under any of Article 7 1 through 5; and
2. 법인이 제7조제6호에 해당하게 된 경우
2. Where a corporation came to fall under Article 7 6.
③ 허가관청이나 등록관청은 제1항에 따라 사업정지명령을 받은 자가 그 정지기간 중 사업을 계속하는 경우에는 그 허가나 등록을 취소하여야 한다. <신설 2019.8.20>
(3) The permitting authority or registration authority shall revoke the permit or registration of a person who has received an order of business suspension under paragraph (1) and continues the business during the suspension period.
④ 제1항에 따른 위반 행위별 처분 기준은 그 사유와 위반 정도를 고려하여 산업통상부령으로 정한다. <개정 2019.8.20, 2025.10.1>
(4) Standards for dispositions by type of violation under paragraph (1) shall be prescribed by Ordinance of the Ministry of Industry and Trade in consideration of the grounds and degree of the violation.
