아동학대범죄의 처벌 등에 관한 특례법 제35조(비밀엄수 등의 의무)

① 아동학대범죄의 수사ㆍ공소 또는 아동보호사건의 조사ㆍ심리 및 그 집행을 담당하거나 이에 관여하는 공무원, 보조인, 진술조력인, 아동보호전문기관 직원과 그 기관장, 상담소 등에 근무하는 상담원과 그 기관장 및 제10조제2항 각 호에 규정된 사람(그 직에 있었던 사람을 포함한다)은 그 직무상 알게 된 비밀을 누설하여서는 아니 된다. <개정 2026.9.29>

② 신문의 편집인ㆍ발행인 또는 그 종사자, 방송사의 편집책임자, 그 기관장 또는 종사자, 그 밖의 출판물의 저작자와 발행인은 아동보호사건에 관련된 아동학대행위자, 피해아동, 고소인, 고발인 또는 신고인의 주소, 성명, 나이, 직업, 용모, 그 밖에 이들을 특정하여 파악할 수 있는 인적 사항이나 사진 등을 신문 등 출판물에 싣거나 방송매체를 통하여 방송할 수 없다.

③ 피해아동의 교육 또는 보육을 담당하는 학교의 교직원 또는 보육교직원은 정당한 사유가 없으면 해당 아동의 취학, 진학, 전학 또는 입소(그 변경을 포함한다)의 사실을 아동학대행위자인 친권자를 포함하여 누구에게든지 누설하여서는 아니 된다.
