신항만건설 촉진법 제17조의2(선수금 등의 승인 신청의 처리기간 등)

① 해양수산부장관은 사업시행자가 제17조제4항에 따라 승인을 신청한 경우 그 신청을 받은 날부터 20일 이내에 그 승인 여부를 사업시행자에게 통보하여야 한다.

② 해양수산부장관은 제1항에 따른 기간에 승인 여부를 결정하기 어려운 사정이 있으면 그 승인 신청의 처리 지연사유 및 연장된 승인 신청의 처리기간을 사업시행자에게 통보할 수 있다. 이 경우 연장된 승인 신청의 처리기간은 20일을 넘을 수 없다.

③ 해양수산부장관이 제1항에 따른 기간에 승인 여부 또는 승인 신청의 처리 지연사유 등을 사업시행자에게 통보하지 아니하거나 제2항에 따라 연장된 승인 신청의 처리기간에 승인 여부를 통보하지 아니하면 각각 그 기간이 종료된 날의 다음 날에 해양수산부장관이 승인을 한 것으로 본다.
