신탁법 제89조(반대수익자의 수익권매수청구권)

① 다음 각 호의 어느 하나에 해당하는 사항에 관한 변경에 반대하는 수익자는 신탁변경이 있은 날부터 20일 내에 수탁자에게 수익권의 매수를 서면으로 청구할 수 있다.

② 수탁자는 제1항의 청구를 받은 날부터 2개월 내에 매수한 수익권의 대금을 지급하여야 한다.

(2) The^ð더 trustee트^r러스티 shall섈 pay페이 the^ð더 price프^r라이스 of어^v브 the^ð더 beneficial베너^f피실 right^r라잇 purchased퍼치스트 within위^ð딘 two투 months먼^θ쓰 from^f프^r럼 the^ð더 date데잇 of어^v브 receiving^r러시^v빙 the^ð더 demand디맨드 under언더 paragraph패^r러그^r래^f프 (1).

③ 제2항에 따른 수익권의 매수가액은 수탁자와 수익자 간의 협의로 결정한다.

④ 제1항의 청구를 받은 날부터 30일 내에 제3항에 따른 협의가 이루어지지 아니한 경우 수탁자나 수익권의 매수를 청구한 수익자는 법원에 매수가액의 결정을 청구할 수 있다.

⑤ 법원이 제4항에 따라 수익권의 매수가액을 결정하는 경우에는 신탁의 재산상태나 그 밖의 사정을 고려하여 공정한 가액으로 산정하여야 한다.

⑥ 수탁자는 법원이 결정한 매수가액에 대한 이자를 제2항의 기간만료일 다음 날부터 지급하여야 한다.

(6) The^ð더 trustee트^r러스티 shall섈 pay페이 interest인트^r리스트 on안 the^ð더 purchase퍼처스 price프^r라이스 determined디터먼드 by바이 the^ð더 court코트 from^f프^r럼 the^ð더 day데이 following^f팔로잉 the^ð디 expiration엑스퍼^r레이션 of어^v브 the^ð더 period피^r리어드 under언더 paragraph패^r러그^r래^f프 (2).

⑦ 수탁자는 수익권매수청구에 대한 채무의 경우 신탁재산만으로 책임을 진다. 다만, 신탁행위 또는 신탁변경의 합의로 달리 정한 경우에는 그에 따른다.

⑧ 제1항의 청구에 의하여 수탁자가 수익권을 취득한 경우 그 수익권은 소멸한다. 다만, 신탁행위 또는 신탁변경의 합의로 달리 정한 경우에는 그에 따른다.
