신탁법 제70조(신탁관리인의 사임 또는 해임에 의한 임무 종료)

① 신탁관리인은 선임 시에 달리 정하지 아니하면 신탁관리인을 선임한 법원 또는 수익자의 승낙 없이 사임하지 못한다.

② 제1항에도 불구하고 신탁관리인은 정당한 이유가 있는 경우 법원의 허가를 받아 사임할 수 있다.

③ 사임한 신탁관리인의 통지의무 및 계속적 사무의 관리에 관하여는 제14조제3항 및 제15조를 준용한다.

④ 신탁관리인을 선임한 법원 또는 수익자는 언제든지 그 신탁관리인을 해임할 수 있다. 다만, 수익자가 정당한 이유 없이 신탁관리인에게 불리한 시기에 해임한 경우 수익자는 그 손해를 배상하여야 한다.

⑤ 해임된 신탁관리인의 통지의무 및 계속적 사무의 관리에 관하여는 제16조제4항 및 제5항을 준용한다.

⑥ 법원은 신탁관리인의 사임허가결정이나 임무 위반을 이유로 해임결정을 함과 동시에 새로운 신탁관리인을 선임하여야 한다. 이 경우 새로 선임된 신탁관리인은 즉시 수익자에게 그 사실을 통지하여야 한다.

⑦ 제1항, 제2항, 제4항 및 제6항의 경우 수익자, 신탁관리인, 그 밖의 이해관계인은 기존 신탁관리인의 사임 또는 해임, 새로운 신탁관리인의 선임 사실을 수탁자에게 통지하지 아니하면 그 사실로써 수탁자에게 대항하지 못한다.
