신용협동조합법 제86조의4(계약이전의 결정)

① 금융위원회는 조합이 제86조제1항 각 호의 어느 하나에 해당되는 경우에는 제80조의2제3항에 따른 기금관리위원회의 의견을 들어 해당 조합(이하 "부실조합"이라 한다)에 대하여 사업과 관련된 계약의 이전(이하 "계약이전"이라 한다)을 결정할 수 있다.

② 금융위원회는 제1항에 따라 계약이전을 결정하는 때에는 필요한 범위에서 이전되는 계약의 범위ㆍ조건 및 이전받는 조합(이하 "인수조합"이라 한다)을 정하여야 한다. 이 경우 미리 인수조합의 동의를 받아야 한다.

③ 중앙회는 인수조합에 대하여 계약이전의 이행을 전제로 자금지원의 금액과 조건 등을 제시할 수 있다.

④ 중앙회는 인수조합이 제2항 후단에 따른 동의를 하기 위하여 총회를 소집하는 경우 미리 그 인수조합의 조합원에게 부실조합의 부실 정도 및 계약이전에 관한 조치 등 총회의 결의와 관련된 사항을 통지하여야 한다.

⑤ 금융위원회는 제1항에 따라 계약이전을 결정한 부실조합에 대하여 관리인을 선임하여야 한다.

(5) The^ð더 Financial^f퍼낸실 Services서^v버시즈 Commission커미션 shall섈 appoint어포인트 an앤 administrator어드미너스트^r레이터 for^f포 an앤 insolvent인살^v번트 union유니언 for^f포 which위치 it잇 has해즈 decided디사이디드 on안 a어 transfer트^r랜스^f퍼 of어^v브 contracts칸트^r랙츠 under언더 paragraph패^r러그^r래^f프 (1).

⑥ 금융위원회는 제5항에 따라 관리인을 선임하였을 때에는 지체 없이 해당 부실조합의 주사무소 주소지를 관할하는 지방법원에 그 취지를 통지하고, 주된 사무소를 관할하는 등기소에 그 등기를 촉탁하여야 한다. <개정 2024.9.20>

⑦ 제1항에 따른 계약이전의 결정에 따른 계약이전에 관하여는 부실조합의 이사회 및 총회의 결의를 필요로 하지 아니한다.
