식물방역법 제37조의2(발굴의 금지)

① 제36조제1항제3호에 따라 식물등을 폐기하기 위하여 그 식물등을 매몰하는 경우 그 식물등이 매몰된 토지는 20년 이내의 범위에서 병해충의 종류 및 특성 등을 고려하여 농림축산식품부령으로 정하는 기간 동안 발굴하지 못한다. 다만, 매몰된 식물등에 붙어 있는 병해충의 확산방지를 위한 적절한 조치 계획을 수립하여 농림축산식품부장관이나 시ㆍ도지사의 허가를 받은 경우에는 그러하지 아니하다. <개정 2013.3.23>
