시설물의 안전 및 유지관리에 관한 특별법 제21조의2(결과보고서 작성 준수사항 위반자에 대한 명단 공표)

① 국토교통부장관은 직전연도부터 과거 2년간 제17조제2항제1호 또는 제2호를 위반한 자(부실하게 작성한 경우는 3회 이상 작성한 자를 말한다)의 명단을 공표할 수 있다. 다만, 이의신청 등 불복절차가 진행 중인 조치는 명단 공표 대상에서 제외한다.

② 제1항에 따른 명단 공표 여부를 심의하기 위하여 국토교통부에 결과보고서 작성 준수사항 위반자 명단 공표심의위원회(이하 이 조에서 "심의위원회"라 한다)를 둔다.

③ 국토교통부장관은 심의위원회의 심의를 거친 공표대상자에게 명단 공표대상자임을 통지하고 1개월 이상의 기간을 정하여 소명기회를 주어야 한다.

④ 제1항부터 제3항까지의 규정에 따른 명단 공표 방법, 심의위원회의 구성 및 운영 등에 필요한 사항은 대통령령으로 정한다.
