Enforcement Decree of the Special Act on the Safety and Maintenance of Facilities, Article 43 (Delegation of Authority and Entrustment of Duties|25)
① 국토교통부장관은 법 제60조제1항에 따라 다음 각 호의 권한을 지방국토관리청장에게 위임한다. <신설 2020.2.18, 2021.4.20>
(1) Pursuant to Article 60 (1) of the Act, the Minister of Land, Infrastructure and Transport delegates the following authority to the Director of the Regional Office of Land Management:
1. 법 제6조제7항 및 같은 조 제8항 전단에 따른 시설물관리계획에 관한 자료의 접수 및 시설물관리계획의 수정ㆍ보완 요구
1. Receipt of data on facility management plans and demands for correction and supplementation of facility management plans under Article 6 (7) and the first sentence of paragraph (8) of the Act;
2. 법 제9조제1항, 제2항, 제4항 및 제5항에 따른 서류의 접수 및 제출 명령
2. Receipt of documents and orders for submission under Article 9 (1), (2), (4), and (5) of the Act;
3. 법 제13조제2항 전단, 같은 조 제3항, 제6항 및 같은 조 제7항 전단에 따른 긴급안전점검의 실시, 실시 요구, 결과 통보, 조치 명령 및 결과보고서의 접수
3. Conduct of and demands for emergency safety inspections, notification of results, orders for measures, and receipt of result reports under the first sentence of Article 13 (2), and paragraphs (3), (6), and the first sentence of paragraph (7) of that Article of the Act;
4. 법 제17조제4항 전단 및 같은 조 제5항에 따른 안전점검 및 정밀안전진단 결과보고서의 접수 및 제출 명령
4. Receipt of result reports of safety inspections and precision safety diagnoses and orders for submission under the first sentence of Article 17 (4) and paragraph (5) of that Article of the Act;
5. 법 제18조제3항부터 제5항까지의 규정에 따른 부적정 통보, 수정ㆍ보완한 정밀안전점검 및 정밀안전진단 결과보고서의 접수, 수정ㆍ보완 제출 명령 및 수정ㆍ보완 요구
5. Notification of inadequacy, receipt of corrected and supplemented result reports of precision safety inspections and precision safety diagnoses, orders for submission of corrections and supplements, and demands for correction and supplementation under Article 18 (3) through (5) of the Act;
6. 법 제24조제2항 및 제3항에 따른 시설물의 보수ㆍ보강 등 필요한 조치의 이행ㆍ시정 명령 및 통보 확인
6. Orders to implement or correct necessary measures such as repair and reinforcement of facilities and confirmation of notification under Article 24 (2) and (3) of the Act;
7. 법 제34조에 따른 보고ㆍ조사
7. Reports and investigations under Article 34 of the Act;
8. 법 제35조에 따른 시정명령
8. Corrective orders under Article 35 of the Act;
9. 법 제36조제1항에 따른 대행실적의 접수
9. Receipt of performance records under Article 36 (1) of the Act;
10. 법 제40조제4항 전단에 따른 성능평가 결과보고서의 접수
10. Receipt of performance evaluation result reports under the first sentence of Article 40 (4) of the Act;
11. 법 제41조제1항 전단에 따른 유지관리 결과보고서의 접수
11. Receipt of maintenance result reports under the first sentence of Article 41 (1) of the Act;
12. 법 제59조제1항 및 제3항부터 제6항까지의 규정에 따른 실태점검에 관한 사항
12. Matters concerning status inspections under Article 59 (1) and (3) through (6) of the Act;
13. 법 제61조의2에 따른 이행강제금의 부과 및 징수에 관한 사항
13. Matters concerning imposition and collection of charges for compelling compliance under Article 61-2 of the Act;
14. 법 제67조에 따른 과태료 부과 및 징수에 관한 사항(제1호부터 제12호까지의 규정에 따라 위임받은 권한을 처리하기 위해 필요한 경우로 한정한다)
14. Matters concerning imposition and collection of administrative fines under Article 67 of the Act (limited to cases necessary for handling authority delegated under subparagraphs 1 through 12).
② 국토교통부장관은 법 제60조제2항에 따라 다음 각 호의 업무를 국토안전관리원에 위탁한다. <개정 2020.2.18, 2020.12.1, 2025.12.2>
(2) Pursuant to Article 60 (2) of the Act, the Minister of Land, Infrastructure and Transport entrusts the following duties to the Korea Authority of Land and Infrastructure Safety:
1. 법 제12조제5항에 따른 시설물의 내진성능평가 결과 검토 및 내진 보강의 권고
1. Review of results of seismic performance evaluations of facilities and recommendations for seismic reinforcement under Article 12 (5) of the Act;
2. 법 제18조제1항 및 제2항에 따른 정밀안전점검 및 정밀안전진단 실시결과의 평가와 그 평가에 필요한 관련 자료의 제출 요구
2. Evaluation of the results of precision safety inspections and precision safety diagnoses under Article 18 (1) and (2) of the Act and demands for submission of related data necessary for the evaluation;
3. 법 제19조제1항ㆍ제2항 및 제9항에 따른 소규모 취약시설의 안전점검 등의 실시, 그 결과와 안전조치에 필요한 사항의 통보 및 안전 및 유지관리에 관한 교육
3. Conduct of safety inspections, etc. of small-scale vulnerable facilities, notification of the results and matters necessary for safety measures, and education on safety and maintenance under Article 19 (1), (2), and (9) of the Act;
4. 법 제36조제3항에 따른 실적관리 및 실적확인서의 발급
4. Performance record management and issuance of performance record certificates under Article 36 (3) of the Act;
5. 법 제55조제1항에 따른 시설물통합정보관리체계의 구축ㆍ운영 및 이 영 제35조제2항에 따른 시설물 정보의 신뢰성과 객관성 확보를 위한 시설물 정보의 확인ㆍ점검
5. Establishment and operation of the integrated facility information management system under Article 55 (1) of the Act, and verification and inspection of facility information to ensure the reliability and objectivity of facility information under Article 35 (2) of this Decree;
6. 법 제55조제4항에 따른 소규모 취약시설의 안전관리에 관한 정보화시스템의 구축ㆍ운영
6. Establishment and operation of an information system on safety management of small-scale vulnerable facilities under Article 55 (4) of the Act;
7. 법 제58조제4항에 따른 중앙시설물사고조사위원회 운영에 관한 사무
7. Affairs concerning the operation of the Central Facility Accident Investigation Committee under Article 58 (4) of the Act.
③ 제2항제2호에 따른 업무를 위탁받은 기관(이하 "실시결과평가기관"이라 한다)의 장은 제14조제1항 각 호에 따른 평가대상 및 같은 조 제2항 각 호에 따른 평가사항에 관한 대상ㆍ기준ㆍ방법 등을 정하여 국토교통부장관의 승인을 받아야 한다. <개정 2020.2.18>
(3) The head of an institution entrusted with the duties under paragraph (2) 2 (hereinafter referred to as the "result evaluation institution") shall determine the subjects, standards, and methods, etc. concerning the evaluation subjects under each subparagraph of Article 14 (1) and the evaluation matters under each subparagraph of paragraph (2) of that Article and obtain approval from the Minister of Land, Infrastructure and Transport.
④ 국토교통부장관은 제3항에 따라 승인한 세부사항을 고시해야 한다. <개정 2020.2.18>
(4) The Minister of Land, Infrastructure and Transport shall publicly notify the details approved under paragraph (3).
