습지보전법 제7조(타인 토지의 출입 등)

① 기후에너지환경부장관, 해양수산부장관 또는 시ㆍ도지사는 습지조사를 위하여 필요한 경우에는 관계 공무원 또는 조사원(제21조제2항에 따라 습지조사를 전문기관에 위탁한 경우에는 그 전문기관의 임직원을 포함한다. 이하 같다)으로 하여금 타인의 토지에 출입하게 하거나 그 지상의 입목(立木), 흙과 돌, 그 밖의 장애물을 변경하거나 제거하게 할 수 있다. <개정 2025.10.1>

② 제1항에 따라 타인의 토지에 출입하거나 장애물을 변경하거나 제거하려는 관계 공무원 또는 조사원은 그 소유자, 점유자 또는 관리인(이하 이 조에서 "소유자등"이라 한다)에게 미리 그 뜻을 알려야 한다.

③ 제1항에도 불구하고 관계 공무원 또는 조사원은 해 뜨기 전이나 해 진 후에는 해당 토지의 소유자등의 승낙 없이는 담장이나 울타리로 둘러싸인 타인의 토지에 출입할 수 없다.

④ 토지의 소유자등은 정당한 사유 없이 제1항에 따른 조사행위를 거부, 방해 또는 기피할 수 없다.

⑤ 제1항에 따라 타인의 토지에 출입하려는 관계 공무원 또는 조사원은 공동부령으로 정하는 바에 따라 그 권한을 표시하는 증표를 관계인에게 보여주어야 한다.
