수산자원관리법 제43조(소하성어류의 보호와 인공부화ㆍ방류)

① 행정관청은 소하성어류의 통로에 방해가 될 우려가 있다고 인정될 때에는 수면의 일정한 구역에 있는 인공구조물의 설비를 제한 또는 금지할 수 있다. <개정 2020.3.24>

② 행정관청은 제1항의 인공구조물로서 소하성어류의 통로에 방해가 된다고 인정하면 그 인공구조물의 소유자ㆍ점유자 또는 시설자에 대하여 방해를 제거하기 위하여 필요한 공사를 명할 수 있다. <개정 2020.3.24>

③ 행정관청이 정하는 소하성어류, 그 밖의 수산자원을 인공부화하여 방류하려는 자는 다음 각 호의 사항을 관할 시장ㆍ군수ㆍ구청장에게 신고하여야 한다. 다만, 행정관청, 「수산업법」 제46조제3항에 따른 시험연구기관ㆍ수산기술지도보급기관ㆍ훈련기관 또는 교육기관에서 방류하는 경우에는 그러하지 아니하다. <개정 2022.1.11>

④ 관할 시장ㆍ군수ㆍ구청장은 제3항 각 호 외의 부분 본문에 따른 신고를 받은 경우 그 내용을 검토하여 이 법에 적합하면 신고를 수리하여야 한다. <신설 2019.1.8>
