수산업법 제65조(어구ㆍ시설물의 철거 등)

① 어업권자나 어업의 허가를 받은 자는 그 어업권 또는 허가의 효력이 소멸되거나 어업시기가 끝나면 해양수산부령으로 정하는 기간 내에 그 어장이나 수면에 설치한 어구ㆍ시설물을 철거하여야 한다. 다만, 그 어구나 시설물을 철거할 수 없거나 철거할 필요가 없다고 인정될 경우 근해어업은 시ㆍ도지사가, 면허어업ㆍ연안어업ㆍ구획어업은 시장ㆍ군수ㆍ구청장이 해당 철거의무자의 신청에 따라 그 의무를 면제할 수 있다.

② 제1항 단서에 따라 철거의무자가 의무를 면제받은 경우에는 그 어구ㆍ시설물과 양식물의 소유권을 포기한 것으로 본다.

(2) Where웨어 the^ð더 person퍼슨 obligated아블러게이티드 to투 remove^r리무^v브 has해즈 been빈 exempted이그젬프티드 from^f프^r럼 the^ð디 obligation아블러게이션 under언더 the^ð더 proviso프^r러^v바이조 to투 paragraph패^r러그^r래^f프 (1), the^ð더 person퍼슨 shall섈 be비 deemed딤드 to투 have해^v브 abandoned어밴든드 ownership오우너쉽 of어^v브 the^ð더 fishing^f피슁 gear,기어 facilities^f퍼실러티즈 and앤드 cultured컬처드 products.프^r라덕츠

③ 제1항에 따른 철거의무자가 그 철거의무기간이 지났어도 그 어구ㆍ시설물이나 양식물을 철거하지 아니한 경우에는 행정관청은 「행정대집행법」에서 정하는 바에 따라 그 어구ㆍ시설물이나 양식물을 철거할 수 있다.

④ 어업의 면허나 허가를 받지 아니한 자가 설치한 어구ㆍ시설물과 양식물에 관한 사항은 제1항부터 제3항까지의 규정을 준용한다.
