수산업법 제42조(혼획의 관리)

① 어업인은 제40조제4항에 따라 포획ㆍ채취할 수 있는 수산동물의 종류가 정하여진 허가를 받은 경우에는 다른 종류의 수산동물을 혼획(混獲)하여서는 아니 된다. 다만, 다음 각 호에 대하여 대통령령으로 정하는 기준을 모두 충족하는 경우에는 혼획을 할 수 있다.

② 어업인은 제1항 각 호 외의 부분 단서에 따라 혼획이 허용되는 수산동물을 허용 범위를 넘어서 포획ㆍ채취하거나 포획ㆍ채취할 것이 예상되는 경우에는 조업을 중단하거나 조업장소를 이동하는 등 적절한 조치를 취하여야 한다.

③ 제1항 각 호 외의 부분 단서에 따라 혼획이 허용되는 어업에 종사하는 어업인은 해양수산부장관이 정하여 고시하는 혼획저감장치를 어구에 부착하고 사용하여야 한다.

④ 어업인은 제1항 각 호 외의 부분 단서에 따라 혼획으로 포획ㆍ채취한 어획물을 제55조제1항제7호에 따라 지정된 매매장소에서 매매 또는 교환하여야 한다. 다만, 다음 각 호의 어느 하나에 해당하는 경우에는 그러하지 아니하다.

⑤ 제1항부터 제4항까지에서 규정한 사항 외에 어획물 중 혼획이 허용되는 수산동물의 확인, 혼획 허용 범위의 준수 여부 확인 방법 및 절차 등에 관하여 필요한 사항은 해양수산부령으로 정한다.
