수산업법 제38조(어업권 행사의 제한 등)

시장ㆍ군수ㆍ구청장은 제36조제1항 또는 제2항에도 불구하고 계원이나 조합원의 소득이 균등하게 증대될 수 있도록 대통령령으로 정하는 기준에 해당하는 자에게 어촌계 또는 지구별수협의 어장에 대한 어업권의 행사를 제한하거나 금지할 수 있다.
